Paralyzed college kid sues his frat buddies

    http://www.13wham.com/news/local/sto...C_4Kz98Mg.cspx

Brockport, N.Y.) - A SUNY Brockport student paralyzed in a fall at a frat house is suing.

Bryan Parslow, 18, filed suit against the landlord of the house where he fell, and several students.

Parslow, who is from Caledonia, was seriously injured when he fell from a second story window during a party at the off-campus house.

In the lawsuit, Parslow accuses the landlord of not installing a screen that could have prevented the fall.

The students named in the suit are accused of supplying alcohol to Parslow.
    ----------------------------------------------------------------

    Suing:
1.) The landlord because of no window screen
2.) The frat boys who "supplied" the alcohol

It must really suck to be paralyzed, but c'mon. When you're consciously guzzling beer from a comically over-sized funnel, the underlying issue is personal responsibility. Unless the kid was pushed, it's probably his own fault. I know the Dram Shop Law addresses people who "serve" alcohol, Yada Yada...but there should be an exception to this antiquated law. He should also consider suing the landowner for the terrain that broke his fall being exceptionally hard.

without seeing what he fell from then I'd have to hold judgement. I've seen houses where 2nd floor doorways open out onto non-existant porches. Maybe the kid was an idiot. Maybe the window was missing its glass. I'm just asking....

He fell from a bathroom window. I've never seen a bathroom window that was big enough for someone, (other than a toddler,) to simply fall out of.

I'm guessing he was either pushed or thrown out the window.

According to the Democrat and Chronicle, (besides the landlord,) he's suing 23 individual students along with the national Sigma Alpha Mu Fraternity and the local chapter.

    That's ridiculous.

In the suit filed in state Supreme Court on April 29, Parslow and his mother, Beth Parslow, accuse the property owner Norman C. Giancursio, of not installing a window screen which might have prevented the fall.

Giancursio did not immediately return a telephone call seeking comment.

Other defendants include 23 individual students along with the national Sigma Alpha Mu Fraternity and the local chapter.

The students are accused of supplying alcohol to Parslow and encouraging him to drink.

Parslow is not asking for a specific amount of damages. Parslow’s lawyer, Philip M. Gulisano of Buffalo, said Parslow is seeking compensation for pain and suffering, wages that Parslow would have been able to earn if he had not been injured, and past and future medical bills.

The lawyer is now looking to sue someone for placing the Gravity setting on "high" that day.

not me. The kid was drunk, he fell. Or he accidentally fell on purpose. I have a student that wants a law suit. She doesn't know for what, but she wants one. Lawsuits are the new lottery.

    What a joke!

The landlord didn't install a window screen that could have prevented this guys fall? I've yet to see a screen that can support the weight of a small child yet alone a grown man. I don't believe there is a a building code requirement that all windows be screened. I'm quite sure that had the window had a screen, ParSLOW and his lawyer would be suing the landlord for not putting a safety net underneath it...

The real question is who opened the window and why do ParSLOW put himself in a position to fall out of it? I can just picture him being so hammered that he thought the window was a door or opened it to puke out of it...

The claim against the students he accuses of supplying him with the alcohol and "encouraging him to drink" is BS too. No one forced him to drink it. ParSLOW is 18, old enough to vote, drive, and get drafted. He's also old enough to make his own decisions and suffer their consequences, which is something I think he'll be keenly aware of for the rest of his life.
