    Windsor Ridge South Phase II public hearing

    The Planning Board of the Town of Lancaster will hold a public hearing on December 21, 2016 at 7:10 p.m., at the Town Hall, 21 Central Avenue, Lancaster, New York 14086 to hear all interested parties regarding applications for preliminary plat approval for the proposed “Windsor Ridge South Phase 2” Subdivision, consisting of 193 Single Family Homes on +/- 116.9 acres.

    The plat is located east of Windsor Ridge South Subdivision, Phase 1 (Parts 1 & 2), south of the South Branch of Slate Bottom Creek, west of the rear yards fronting Bowen Road and north of the Town of Elma.

    Further information, including access to a copy of the proposed preliminary plat, may be obtained at the Town of Lancaster Town Clerk’s office, 21 Central Avenue, Lancaster, New York 14086.

    Further information can also be obtained in reading the Planning Board minutes of November 16, 2016 – which also describe the board’s conditions set on approval of the preliminary plat and recommendation for approval to the Town Board.

    How is possible that the Planning Board recommended approval of the revised preliminary plat plan to the Town Board (as stated in the November 16 minutes) before holding a public hearing?

    The site plan was approved in 2007. Only Phase 1 was approved for development (78 homes) because of lack of sewer capacity. With the new sewer line completion in spring of 2017, that issue no longer exists. The site plan approval in 2007 stated the development would take place in 6 phases.

    Since 2007, much development has taken place in subdivisions connecting to William Street. It is nice to see the Planning Board request a traffic study addendum in the conditions. Hopefully, it would encompass a detailed traffic study.

    Nothing is mentioned of the wetlands except monumenting the wetland and buffer areas. It has been 9+ years since the Phase 1 project began and wetlands continue to grow – and especially when water is being pushed by surrounding development.

    Is there any time limitations between approval and shovels in the ground?

    There will be 3 cul de sacs in this phase. If I remember correctly, Amatura had requested no more cul de sacs due to the plowing difficulties.

    The cul de sacs were approved in 2007, is the town board bound by an approval made almost 10 years ago?

    Maybe, they could add an addendum that stated any developer creating a cul de sac must provide their own plow service for that cul de sac.

    I'm hoping that they don't flood slate bottom creek more than it already is.

    Are you saying the public hearing tomorrow night is just for show, since they've already recommended approval?

    I am not saying that, but as the following language was used at the November 16th Planning Board meeting:

    Based on the information presented to the Planning Board, a motion was made by Melvin Szymanski to recommend approval of the revised preliminary plat plan to the Town Board with the following conditions:

    it begs the question, which will be asked, is why the recommendation was made prior to holding the necessary public hearing.

    And, since it’s been over 9 years since the preliminary plat was approved, other questions bear asking as well.

    Are they bound by that approval of the preliminary plat made so many years ago?
