    Honor Indian Treaties

    Hey, I found this, I am sure you all already know but I thought it was wirth posting. Hope no one minds.

    The U.S. Constitution calls treaties "the Supreme Law of the Land." And yet New York State is about to violate U.S. treaties that have lasted over 200 years. The state plans to implement regulations that would impose sales tax on petroleum and tobacco products sold on Indian lands. These regulations would violate sacred treaties between the U.S. and Indian tribes.

    Since 1794 the U.S. has acknowledged Indian independence, and the Treaty of 1842 clearly says the Seneca Nation will not be taxed by any US government. Including New York State. The state's unconstitutional action will cause over 1000 Indians and non-Indians to lose their jobs, consumer prices to rise, and businesses to close.

    We urge you to explore this topic and learn more about this issue. Tell Governor Pataki how you feel. Urge the Governor to honor the supreme law of the land. Because if you break a treaty, you break the law

    But NYS isn't going to tax the Senecas, it only wants to tax sales to non-indians on reservations. No Seneca would be paying any taxes.

    The treaty says the Seneca Nation will not be taxed... and they're not going to tax them.

    300miles is right. But... If NYS legislators could figure out how to tax wildlife, they'd do it. Even roadkill would be subject to a death tax. God forbid we don't squeeze the last penny out of everything in sight - treaties or sanity be damned.

    Why should non-Indians have to pay taxes when they buy something on a reservation? Do you have to pay New York State sales tax on something you buy in Canada?

    Besides why wouldn't we want to promote business on the reservations? It means more people have jobs and less are on welfare. That would probably cancel out the loss in tax revenue.

    Yes. Actually you are supposed to report the underpayment of state tax on your income tax return. This goes for all out of state purchases including internet, phone and mail order.

    Indian sovereignty is not on par with a foreign nation. Indian reservations are still part of the US.

    Oh Please Only if you are Mr. Goody Two Shoes!

    I don't see how giving the Indians a break by allowing non-indians to buy stuff there tax-free is any different than other anti-poverty or economic development strategies. There are programs in place in other parts of the country where businesses don't have to charge sales tax if they locate in a low-income area. It's done as an economic development incentive. Why not do it on the reservations?

    Why not create new capital so that they can become self-sufficent instead of being on welfare? It also allows WNY'er to buy things at a lower cost so that they don't have to pay the NYS tax rates that only people downstate really have the incomes to afford. What am I missing here?

    It never fails, people in WNY go against their own interests everytime!

    New York state has added a line to income tax returns requiring all residents to calculate how much they should pay on Internet, mail order or out-of-state purchases. The threat is explicit: Anyone who creatively underestimates will face stiff penalties if an audit occurs.

    "If you've written zero or left it blank, during the audit we're going to make you produce your financial records, bank statements, credit card statements," said Michael Bucci, a spokesman for the New York Department of Taxation and Finance.     You can just use their table to 'estimate'
    If your federal adjusted
    gross income is: Tax amount
    up to $15,000*................. $ 5
    $15,001 - $30,000........... $15
    $30,001 - $50,000........... $22
    $50,001 - $75,000........... $27
    $75,001 - $100,000......... $39
    $100,001 - $150,000....... $54
    $150,001 - $200,000....... $68
    $200,001 and greater...... .0341% (.000341)
    of income, or $200, which ever amount is smaller

    How does that work? If you buy something in another state and pay that state's sales tax... what tax do you owe NYS?

    I thought NY only tried to tax purchases that were completely untaxed, like online purchases.... or is that what you meant
