“We in America do not have government by the majority. We have government by the majority who participate.” ― Thomas Jefferson
it is an interesting issue and one that needs to be resolved asap. But without a ninth SCOTUS justice, however, where and when the issue gets litigated might be more important than it would otherwise be.
It will probably have a bigger impact on the primary elections than it would on the general. For example, if a NYS court holds he is not a natural boarn citizen, then he can't get those NYS primary delegates and might lose the republican nomination because of it. But if he becomes the Republican candidate and the split SCOTUS doesn't decide the issue, the the fact that he is not on the general election ballot in NY is probably of no real consequence because he wasn't likely to win any delegates from NYS in the general election anyway.
Whatever happens, this presidential election will go down in history as one of the most fascinating in our history.
