    I am going to try to get this thread back on track. If any of you watched the Cspan video it should have at least made you think regardless of what side you take in the discussion.

    Question "Can the Cheif exective ignore laws that are permissive and Mandatory?"

    Answear: "It is well established that the executive Branch has prosecutorial discretion"

    Question "What are the limits to that prosecutorial discretion?"

    Question: " if the president can fail to enforce immigration laws can the president decide not to enforce election laws?

    My question is this, if he can dispence with marijuana laws, immagration laws, or mandatory minumums can he also dispense with election laws?

    Can the president suspend election laws?

    Question: Why not? If he can suspend mandatory minumums and immigration laws then why not election laws?

    Answear: Because the president is bound to obey and apply the law

    Question: Well he isnt applying the ACA, Mandatory Minumums, immagration laws and he isnt applying Marijuana laws, whats the differnce with election laws

    can someone please post about the subject and not about Love of Obama or hate of Bush or what is is or what I really am thinking.

    This is an interesting topic to me. I would really like to know from someone else that watched the Cspan video or read the book I referenced what they think.

    Supreme Court Limits Presidential Recess Appointment Powers


    Handing a victory to those who fear the executive branch has overreached in recent years, the Supreme Court has reined in the President’s power to appoint officers of the government when Congress is in recess. Weighing competing clauses of the constitution, the justices ruled Thursday that the President cannot circumvent the framers’ requirement that he seek the Senate’s advice and consent on executive branch appointments if Senators are only formally in recess for three days.

    The ruling undermines hundreds of decisions made by the National Labor Relations Board in 2012 and for half of 2013, when the board comprised unconfirmed recess appointees. Those decisions will be revisited by the board that has since been confirmed by the Senate.

    Today President Obama advised us not to listen to the cable news shows, Washington pundits, and any media coverage that focuses on his administration's screw ups. This scandal business is nothing more than phony allegations says Obama. And to think that Pinocchio will get away with this one with the biased media and supporting libtards.

    It was also sad to have heard the results of a poll today that claimed that only 40% of uber-liberals are proud of their country. How can that be when their man King Obama is running the country?

    So what? the House spent $$$ and lots of wasted time voting almost 40 times to repeal the Patient and Affordable Care Act.

    2. If Mr. Boehner wants to sue the President, I support him doing that. But not as Speaker of the House, not as Representative Boehner, but citizen Mr. Boehner, in a civil court. Let Boehner pay for the legal costs, not the taxpayers. Because I thought the GOP hates spending taxpayer money on frivolous things.

    3. If the Republicans gain a majority in the Senate in the November elections, but not enough to pass bills without Democratic votes, there will never be a removal of the President from office if the House impeaches him. And then the GOP can get a taste of what they've been giving the Democrats the last 2 years in the Senate by voting for the benefit of their party, and not the benefit of the country. (Yes, I blame Democrats for doing that too)

    4. The recent ruling by the Supreme Court of recess appointments: it affects all Presidents, current and future. No doubt if a GOP wins the White House in 2016, they will work to reverse that ruling. Here is a statistic to ponder:

    "According to reports from the Congressional Research Service, during their time in office President Ronald Reagan made 240 recess appointments, President George H. W. Bush made 77 recess appointments, President Bill Clinton made 140 recess appointments, and George W. Bush made 171. Obama's first term has seen a paltry 28. In this context, Obama's move seems less like a power grab and more like the proverbial 98-pound weakling taking a second to wipe the sand out of his eyes. "

    But the real issue here, is what defines a real 'recess', a rule I think that is interpreted differently between the House and the Senate, with the House refusing the Senate to adjourn to a real 'recess', forcing these ridiculous 'Pro Forma' Sessions.
