    What is happening with Wal-Mart?

    What is going on with the Wal-mart on William & Transit? Every time someone says something about it, it's a different day or season to start construction. Does any one here really know when it's going up? & Yes, I know it's a bad thing.

    Status is the same as seven years ago - opening by Christmas.

    According to Supervisor Giza, Wal-Mart is supposed is begin construction sometime in July. Considering the residents of Northwood Village reached an agreement a year ago regarding community and environment prtective measures, it is disheartening to see Wal-Mart not making any effort to abide by the site plan conditions.

    At the Town Board meeting of 6-01-09, I presented the following:

    In early 2006, Wal-Mart purchased the land they are developing on from Bella Vista. In 2007, they commenced clearing the land and building a berm adjacent to the 60-foot conserved wooded area. However, they incorrectly staked out the land and disturbed the conserved area destroying many trees in the process.

    In June of 2008, Wal-Mart modified their site plan and received approval from the town with numerous conditions instated to protect the neighboring residents and the environment.

    Since the 2007 disturbance, excepting removing some trash that blows onto their cleared, vacant land, onto the conserved area (and which in fact lands in our backyards), they have not been on the site to mitigate any issues as identified by the conditions in the site plan. Wal-Mart keeps telling town officials, who in turn tell us, all issues will be addressed when we commence building the store.

    Wal-Mart is again giving a starting date of July 2009. Yet in last week’s Buffalo News, it was stated that the Lancaster Wal-Mart store is scheduled for opening in late 2010. It will not take 1-1/2 years to build a Wal-Mart. You know that as well as I do.

    The residents of Northwood have come to an agreement with Wal-Mart on certain terms. We have been patient in waiting for the remainder of the berm to be built, trees to be removed and replaced in the conserved area, the constructed berm to be maintained, etc. However, the pond was constructed two years ago and we have yet to see Wal-Mart on site to address the drainage issues that adversely impact our drainage system.

    I will submit the following photos to the board that also show the size of the collection ditch and the extent of water in it before it enters a culvert to the retention pond. Look at the debris and garbage at the base of the culvert which impedes water from entering the bottom inlet. There are photos showing both culverts at the east and west ends in the same condition. There is a reclining chair in the retention pond, scum on the surface and geese waste and feathers all around the pond.

    It is my understanding that until such time Wal-Mart completes site construction they are responsible for site drainage issues and pond maintenance. Should Wal-Mart not begin store building in July of 2009, the town board should take action to protect the residents and environment as is their office responsibility. If that means involving the Health Department, so be it. This site is disgusting. As a proclaimed Gateway to Lancaster, it currently falls far short of being a respectful one. It is becoming a harborage for pests and birds.

    Wal-Mart owes it to the neighboring residents to prep the site and maintain it considering they violated the conserved area “no disturbance” condition, where retention pond blasting did occur and has been suspected as the cause for some basements suffering structural damage, and where one of our detention ponds does not drain as it did before Wal-Mart’s retention pond created.

    Supervisor Giza and Councilmember Dan Amatura declared they would contact Wal-Mart the next day. It's a week later and no one from Wal-Mart has been on site.

    It will take them until xmas to clean up the crap on site!!!!!!!!!!!!!

    By crap do you mean, trash from the odd mix of gas station, and crap food joints that welcome people to the gateway of lancaster? Do you mean the dead trees, weeds, and stagnant water caused by what construction was done? Or do you mean actual crap, like what the geese leave behind?
    The town board creates the problems and when the residents complain, the town board tells them it's the resident's fault.
