    Cuomo to sign SAFE Act exemption for retired police

    ANOTHER DOUBLE STANDARD. WE MUST GET RID OF EVERY ONE OF THESE PUKES IN OFFICE!!

    ALBANY--A bill to exempt retired law enforcement officials from a portion of the state's new gun laws is headed for Gov. Andrew Cuomo's desk after the Senate approved the measure early Friday despite disagreement among the chamber's Republicans.

    If signed into law, retired police officers, peace officers and certain federal law enforcement agents wouldn't be subject to New York's ban on high-capacity magazines, so long as it was purchased for their official duties.

    Under state law approved in January, magazines can't hold more than seven bullets, except at a gun range or competition.
    The Senate passed the bill around 2 a.m., which drew criticism from nearly half of the Senate GOP, which shares control of the chamber with the four-member Independent Democratic Conference. The Democratic-led Assembly passed the bill in May.
    The measure passed by a 49-14 vote and was sponsored by Sen. Martin Golden, a Brooklyn Republican who is a retired New York City police officer.
    Sen. Greg Ball, R-Patterson, Putnam County, said the bill was put to a vote in the early hours of the morning to prevent public attention. He said the changes to the Secure Ammunition and Firearms Enforcement Act-which widened the state's assault weapons ban and implemented tougher penalties on illegal gun owners-have split Senate Republicans. He blamed the divide he blamed on Cuomo, the main supporter of the new gun-control measures.
    "I'm glad Senator Golden can protect his family," Ball said during the Senate debate. "How about the victim of domestic violence in her home, who now doesn't have a home exemption?"
    Golden said criticism of the time of the vote was unfounded because the bill was first introduced weeks ago.
    Cuomo hasn't signaled whether he will support the bill.
    The SAFE Act was shepherded through the Legislature in January by Cuomo after high-profile shootings last year at Sandy Hook Elementary School in Connecticut and in Webster, Monroe County. The new law has hurt Cuomo's standing among gun owners-particularly those upstate-and led to lawsuits challenging it constitutionality.
    Assemblyman Bill Nojay, R-Pittsford, Monroe County, ripped the exemption and called on Senate Republican Leader Dean Skelos, R-Nassau County, to retire. Nojay has led a number of protests at the Capitol against the gun-control law.
    "At this point, the only way to salvage the 2014 cycle for the Senate GOP is for his fellow Republicans to thank Skelos for his service and let him retire to spend more time with his family," Nojay wrote in an email.

    Will veterans be exempt also?

    If signed into law, retired police officers, peace officers and certain federal law enforcement agents wouldn't be subject to New York's ban on high-capacity magazines, so long as it was purchased for their official duties.
    Many military service men own high-capacity magizines and ar's. Will retired veterans be exempt also?

    So ex cops are afforded better defense then non cop citizens. WOW. Fundamentally all cops are citizens anyway, they are not military.

    if purchased for offical duties. if they are retired what offical duties do they have?
    One good thing about growing old is your secrets are safe with your friends they can't remember them either

    But they are trained better than civilians and that is the point of the exception, LEOSA, peace officer authority for federal officers etc.

    A retired Buffalo Police Officer J.Rybacki had over ---------------- 3000 guns/rifles/pistols. He was a regular at gun shows - always had at least two tables of items for sale. No one ever questioned him about a federal license - after all he was a Buffalo Police Officer.

    This exemption only admits the fact that government and law enforcement people believe they live by different laws/standards. Thats why so many of them are so conflicted, they have to enforce laws and rules - they them selves can't possibly live up to.

    Now Governor Cuomo is acquiescing to that reality - he's giving them a out - a pass. Why - because he himself knows theres no way to enforce the rules he makes for us - on people of the institution.

    Am I saying the Cops are wrong - am I saying Cuomo is wrong - NO - I am saying we all should be allowed to share the same rights and considerations.

    He knows - Government knows - they might need those chosen few enforcers if the sheets hit the fan. Whether its locals, state level or Fed level - they are the "extra" ace in the hold. The system will need all the support they can get - right wrong or indifferent - those with past training will align themselves with the Gov - turning their collective backs on who ever their told is on the "wrong side."

    14th Amendment to the US Constitution reads in part:

    "No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws."


    Its pretty cut and dry. Its called equal protection under the law. The same goes for these "tax free zones" Comrade Cuomo just rammed through the Senate at 2am.

    No question about it, However the effective hit rate under stress, is still not great for much of the LE community. Then there are those you tube videos that show shop owners returning fire hitting their mark dead on. But yes of course they are better trained, maybe all the more reason a civilian should have more rounds to stop a threat. Personally I would go to thunder ranch if I had the cash.

    Its not just about hitting a target but about WHEN you can shoot. Being cognizant of background, proper use of force, that sort of stuff.

    There is much more to addressing a deadly force threat than the ability to pull a trigger.

    FYI

    Talk about avoiding "Back ground Checks" - over the years - all you needed was a badge to buy a gun. Yes, no paperwork if the sale was individual to individual - officer to officer - gun dealing officer to the public.

    Many people that used to be regular sellers at swap meets and then guns shows - were in-fact law enforcement members. Thats a documented fact. They have avoided addressing this through out the entire "Stop the crime debate"!

    Now they have to give them a pass - why - think about it - you can use Cops to take guns from ordinary citizens but how do you confiscate guns from law enforcement - active or retired ?

    Most of the sellers at guns shows about five years ago were Cops, Corrections Officers and retired law enforcement. Think about that - the biggest argument they put forth was the supposed "Gun show/flea market Loop hole" - now break it down - these guys still have large caches of fire arms and ammunition.

    But its us their looking at.

    It's amazing with one firearm per 300 million people in the US why you don't hear of more problems. What you do hear about mostly is that element of society that uses a firearm with out any regard to what you mention above. Most intelligent people with firearms know, civil suits, grand juries, attorney fees, psychological counselling, lost work is simply not worth your dvd player. Otherwise we would hear of many more mishaps.
