    Angry Collecting taxes on reservations

    Italic Times crimson I understand that the State (NY) wants to collect sales tax on non indians who make purchases on Indian Reservations. They also show court cases to up-hold there case, but lets face reality, an Indian Reservation is a Nation in itself. Just like the Vatican is a city inside a city (Rome). If I go to another State and make a purchase in that State and it doesen't have a sales tax or even if it did I won't pay a NY Sales tax on that product as I didn't purchase it in NY. I won't pay sales tax on anything I purchase on a Reservation either as a Reservation is its own Nation. It would be like NY State telling Canada that all people who live there had to start paying NY sales tax. This State is already collecting enough money in taxes, just what are they doing with it ALL. Enough already....

    Untrue, the US Supreme Court does not recognize sovereignty as foreign nation.

    American Indians, whether on reservations or not, are considered US citizens

    American Indians are subject to state and federal law

    Indian Sovereignty translates only to self administration.

    I am very pleased that credit card companies will no longer be accepting charges for cigarettes

    I hope that they will be adding sales tax at the point of manufacture soon and end this whole tax collection loophole for all merchandise including cigaretts and gasoline.

    ALL MEN ARE CREATED EQUAL (I DO NOT SUPPORT INSTITUTIONALIZED INEQUALITY)

    NO TAXATION WITHOUT REPRESENTATION (FOR INDIANS THAT MEANS NO REPRESENTATION WITHOUT TAXATION).

    Hey, this is not the Empire State, it's the Vampire State. If you buy something elsewhere and bring it back home to use, you're supposed to be a good little cash donor and pay taxes here for it also.

    lower taxes

    only way to stop people from making purchases out of state on the internet or on reservatons is to lower the state taxes so they cant save so much when doing it. and if anyone thinks I will fill in that special line on the tax return I have a bridge to sell you .Oops to late some one already bought london bridge,

    I'm not filling out any lines, either, but I wouldn't put it past the state to start tracking purchases made with credit/debit cards. The technology is available, and it's just a matter of time till big brother will be watching.

    So, the whole .05 cents savings I 'd get for buying gas at the res will be gone??

    I mean, for crying out loud. I'm SO sick of hearing this argument.
    Very few Indian shop are anywhere near non Indian shops, #1.
    The savings on Gas is not what it used to be, when the split was $1.40 regular/$1.15 Reservation.
    And who CARES about cigarettes?? If people want to kill themselves for less money, then so be it.....

    I agree, HipKat, although with gas running $2.24 in Jamestown and $1.99 at the stations along 438 near Gowanda, I fill up regularly when I visit the area. The differential at Reservation stations along I-86 has always been less than in Gowanda.

    Thats only 25 cents lower in price. I thought that the state and federal taxes on a gallon of gasoline were more than 25 cents.

    My interpretation: if you are Native American....you pay no tax. If you are NOT Native American......you should pay the tax

    The more I think about this, the more it seems like it's sovereign territory at the discretion of government. It's ok to make a piece of property territory and turn it into a casino because then it's territory and not part of the state that doesn't allow casinos even though there's payment made to the state and local governments. It's not ok to run another kind of business on territory if only the Nation gets anything out of it, not the government. So, basically, the government position is "you're sovereign as long as we make money from it"?

    American Indians are american citizens and their land is US Property

    Their Indian Sovereignty is only for self administration purposes.

    The Federal Government and the States can use imminent domain to demand compliance to law and frankly I support that 100%.

    tax breaks are for the indians only

    from what I can understand the treaties say we cant charge taxes to the indians when they buy something on the reservation no one else is mentioned. they want schools roads fire and police protection welfare etc etc but wont pay taxes good then charge them a "fee" differant name for the same thing but that has been used against use and has proven leagal so turn the Fees on the senecas lets see school fee highway fee garbage fee light fee health insurance fee by the time the state gets down they might ask to be taxed

    Actually, I worked in a store when I was still in school and they didn't pay taxes on things bought off the rez either. The main problem is that everone involved in the issue is just picking the parts of the treaty that they want at the time they want it. Social services ..... treaty, what treaty? Taxes .... sovereignty. Casinos .... don't get me started. Nobody should be able to have it both ways.
