Kevin Gaughan
Regional activist Kevin Gaughan wants 16 village governments in Erie County to be dissolved by 2012.
Regional activist Kevin Gaughan is calling on all 16 village governments in Erie County to merge into their surrounding towns in the next four years.
Gaughan, who has been spending the last eight months speaking to village and town boards throughout the county, made his presentation at the Harbour Club in Buffalo.
Gaughan also released a letter to the mayors of each of the 16 villages, asking them to begin talks on how to merge their village government into their surrounding town, and agree to a date by which this reform will be accomplished

I hope that the villages are forced to dissolve. The consolidation would not only eliminate dual services, but would eliminate many unnecessary expenses. This would be a huge step in the right direction.Originally Posted by kernwatch

Since when is it illegal for a group of people in a small geographic area to band together into a municipality? What are the laws governing such an action, and under what auspices can it be "disallowed"?

It's not illegal. There is no area without some sort of designated municipality in place, be it a town, village, hamlet, etc. If memory serves, Home Rule law regulates the merging various municipalities. Subsequently, they can only merge into a NYS recognized form of government (city, town, village, etc) but not a "Metropolitan" (seemingly NYS hasn't caught up with the rest of the nation).Originally Posted by run4it
But can they be legally impelled to move or dissolve?

Doesn't the state via charter approval have the ability to impel cities or towns to merge? Basically, isn't a municipality's existence, more or less, at the discretion of the state?Originally Posted by run4it
Dunno...that's why I'm asking (and hoping for actual legal verification).Originally Posted by CSense

Nice job, C!
From what I read there, the county cannot impel merger...it can only be commanded from the state level.
Anyone wanna guess how much of a rat's ass Albany gives about studying government structure in and of Erie County municipalities?
