    Bastard Sues Amherst.

    Family Suing Amherst Over Pepsi Center Incident
    Thursday, July 19, 2007 07:19 AM - WBEN Newsroom

    Amherst, NY (WBEN) - The mother of a young boy accused of firing hockey pucks at little boy at the Amherst Pepsi Center in April, is planning to sue the town.

    The Amherst Bee is reporting that Chalene VanDusen, the mother of Michael VanDusen, is claiming negligence and carelessness after the boy was forcibly removed from the ice by a man who said the child would not stop shooting pucks.

    Charles Schmidle has been charged in the case. He says he there was no supervision in the center, and VanDusen was without parental supervision.

    She sued Anthony Pignataro for male practice back in 1997. That tells me she has fake boobs.

    Agreed - but at the same time, watch your kids. The little boy should not have been shooting pucks at him to begin with.

    This is more about money, not principle. The town has deeper pockets. It's that simple.

    Oh, that's absolutely right, the boy should have been supervised. But the father could have taken his son and walked off the ice to speak with a manager and dealt with the situation easily.

    What is her claim? Lack of supervision by town employees? If so, I would argue (if I were the Town Attorney) that she should look in the mirror about supervising her child before complaining that the town's lack of oversight.

    Pot calling the Kettle black in hopes of a windfall of money. Such a shame.

    You would be the first to sue. All of these people in the "lawyers/lawsuits are the bane of society" group are the first to sue.

    Irrelevant. There is actual negligence in this case.

    Seems like an unfair assumption that you make on Crabapples...

    I always get annoyed with poster's who tell you what other's posters would do.

    I don't think this lady has grounds to sue. It is not the Town's job to babysit her ill-mannered child. Maybe she should spend some more time parenting instead of trying to sue the town. Any 5 year old should know that you shouldn't be shooting pucks at an adult - or anyone for that matter.

    Seems like people are becoming more and more sue-happy these days - always trying to take the easy way out.

    Update:Charlene VanDusen has called WBEN denying any claims that she's suing anyone.

    WBEN spoke with Tom Jones, Amherst Town Attorney, who has verified that they've received a "Notice of Claim" from VanDusen's attorney. That's the first step in a lawsuit.

    Google her name and you will see the most recent lawsuits - one in 2006 against a private company, dismissed. That was a personal injury case. Also from google, her petition was on the agenda at the Amherst board meeting 7/16/07.
