    Missouri Voters Reject Health Care

    Fighting Obummer care

One of the more interesting results of the Aug. 3 primaries is the overwhelming passage of Proposition C in Missouri.

Proposition C would prohibit the government from requiring people to have health
care insurance or punish them for not having it 20 more states to follow.

It's a good thing in our great Nation, that a state can not reject out of hand, laws passed at the Federal level. 14th amendment and Article VI and all that.

ObamaCare is destined to fail. A judge in Virginia just ruled that the law was UnConstitutional.

No he didn't, he ruled that he saw enough reason to see that it may be unconstitutional and is allowing the lawsuit to proceed!

You're right, my mistake- poorly worded. It's still destined to fail on Consitutional grounds though. Many other states have suits awaiting trial.

    On what grounds?

I can name one right of the top of my head which gives the authority for making this law, especially the biggest pain point people seem to have:

"The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defence and general Welfare of the United States; but all Duties, Imposts and Excises shall be uniform throughout the United States;"

I'll let you figure out where I pulled that text from.

Now where in that ammendment does it give the govt the right to FORCE anyone to buy a private service or pay a fine.

You're not forced. You still can choose to have insurance or not. If you don't, you pay higher taxes. If you do, you pay lower taxes. You are not "forced" anymore than you are forced to carry insurance on a car.

    It's a discriminating tax.

Then I suppose a tax credit for buying a home is a discriminating tax as well.

However, on the basis of "discrimination" is fails. It does not discriminate on the basis of religion, race, sexual orientation, veteran status, or disability. Those are the only protected classes.

No, because the savings from the housing tax credit are passed on to the tenants too.

I'm sure they could argue the disability portion.

But then again everyone whose getting fined could just join one of the religions that have an exemption to the fine.

And the savings from having insurance are passed onto family members. So, what's the big deal?
