According to Town Supervisor
Sheila M. Meegan, the facility was closed Jan. 5 upon the recommendation of town engineers and code enforcement officers.
At the Town Board meeting on Monday, members adopted a proposal from Building Science Services, LLC for a forensic audit of the structure and authorized the town attorney to examine any legal remedies to recover costs.
“A building less than 15 years old should not have a problem,” Councilman Eugene Hart said during an earlier Town Board work session.
Construction on the Burchfield Center began in 1999, and the facility opened in 2001. The 5,500-square-foot building, which is located at 2001 Union Road, housed town offices, including finance, human resources, the town attorney and paralegal, as well as various community activities.
The 29-acre park portion of the facility will remain open.
Meegan said town employees have been relocated and others at the Burchfield divided the responsibilities of contacting those with scheduled activities.
“Everybody’s been moved out. We’re trying to find other places for those groups,” she said. “Public safety is priority one.”
The supervisor said she anticipates a shutdown of perhaps 120 days. She added that the center is an important building that plays a major role in recreation activity.

On Friday, State Supreme Court Justice Joseph Glownia issued a ruling dismissing the Town of West Seneca’s claims against the design professionals involved in constructing the Charles E. Burchfield Nature and Art Center.
Town Attorney John Fenz said the board is considering the ongoing legal proceeding and has issued the following statement.
“The Town respectfully disagrees with the Court’s decision to dismiss the lawsuits against the Burchfield design professionals on the basis of the expiration of the statute of limitations. The Town firmly believes it is correct on the law and is exploring its options in pursuing an appeal. The taxpayers should not be held financially accountable for the negligence of third-parties. The Town will continue to explore its available legal remedies to recover from the responsible parties.”

Don’t give up hope. The judge who handled this case is a clown. His decisions are often reversed on appeal. I hear he plays favorites.
