    Summation is that at about 1 am Sunday morning, an intruder was shot and killed by an Amherst homeowner. Reports coming out are saying that the intruder was a teacher from Albany attending a diaper party nearby.

    People are blasting the homeowner for shooting first without finding out what was going on. Screw that. Someone strange in my house at 1 am? I'll do whatever it takes to protect me and my family.

    Interesting situation to say the least.

    I think for anyone to have an opinion on this they would need to know the following.

    What exactly does 'break in' mean?
    Where was this diaper party?
    Was this guy drunk or high?


    If the doors were locked, the homeowner had every right. If the doors were unlocked, which is possible in this area of town, it becomes subjective. You then need to know what the argument was and how long it lasted. You also need to know if the person who was shoot was drunk or high.

    we dont need to know none of that! The guy entered another persons house unlawfully and was shot and killed by the home owner I am sure the home owner percieved the intruder as a risk to himself and his family its a sad situation and also a situation that the home owner did not ask for

    I was waiting to start this thread with more information. To be hoenst the ONLY reason i can think this happened is Mr. Park got as little drunk and walked in to the wrong house and tried to go to sleep in the room place!

    It's really tragic all the way around.

    One guy dead, another knowing he killed a seemingly decent guy who probably didn't have any criminal intent.

    Now the sister of the deceased has raised the issue of warning shots. A lawsuit can't be far behind.

    Unless some other facts come out, I'd say the homeowner gets the benefit of the doubt on what has been reported so far. Assuming these are the facts:

    1. It was 1 am. The house was dark. The occupants were asleep.

    2. They discovered a strange person in their house

    3. They warned the stranger that they were armed.

    4. They called 911 before employing self defense.

    If, however, they had no reason to believe they were in danger, for example if the guy was passed out on the kitchen floor, then the conclusion might be otherwise.

    It is a tragic event for all involved, but the homeowner seems to me to be the least responsible for the ending.

    But then there was this quote in the News:

    "I don't think shooting somebody solves anything. Why couldn't this person just fire a warning shot?"

    There is a reason that the national standard among police agencies is not to fire warning shots. First, it is ineffective. This is not TV. If the bad guys aren't stopped by the sight of your weapon they aren't going to be impressed by you wasting a bullet.

    Second, it is dangerous to yourself and innocent people. If the circumstances justify discharging a weapon, then they justify discharging it to stop the intruder, not to scare him or to wound him, but to stop him.

    Good point. If you break into my house and I shoot a warning shot that goes through my window into my neighbors house and kills someone, I'm going to jail! However, if you come at me and i feel my life or a family members life is in danger I can shoot you all I want!

    I see what you are saying. But there is degrees to this stuff.

    I live in a condo tower were units are in stacks and every floor looks exactly the same in the halls. When home, I do not lock my door. There have been several times where stupid contractors or cleaning ladies have gotten off on my floor and entered my unit when they thought they were entering a unit on a different floor.

    This shocked the hell out of me and pissed me off, but I did not shoot the person. I yelled at them but that was about it. What you are saying is I have the right to shoot them. Am I understanding you correctly?

    Of course, every time it happened was in the middle of the day and not at 1am but I hope you can see my point.

    The homeowner had legal right to do what they did. But until people know the details, and I doubt we ever will, you just have to say it was an unfortunate event.

    I think a lawsuit is actually the best thing the homeowner could ask for. The reason for this is I doubt the person was drunk or stoned. I have been hammered and been around people who are REALLY REALLY high on weed...and I do not see entering another house as a possibility in either situation.

    However, if the person was on something like LSD, I could see them having no idea what they were doing.

    I am sure an autopsy is going to be done and a toxicology screen will fill in a lot of the gaps in the story.

    The door was unlocked, he walks in, expecting to see a party. Homeowner says "I have a gun." Guy is all blitzed, thinking it's some kind of joke "Yeah, you have a gun, right - now where's everyone else."

    Where did the part about him being blitzed and thinking the "I have a gun" was a joke?

    And it was a shotgun. You gotta be blind not just blitz to miss a standard sized shotgun.

    And last, but not least, the firearm is not responsible for the result. The same result could have happen if the homeowner had a samurai sword or a bat or dog called Kujo.

    Apparently so. Although I can't imagine why. Are they expecting someone to come over and wake them up to chat?

    A few months ago a woman was found dead in her home in one of those WNY so-called "nice neighborhoods." (I think it was the case where they later determined her son had killed her.)

    The first few tv news casts about the incident showed an interview with a resident who said "this is such a nice neighborhood. Nobody even locks their doors at night."

    When I heard it my first thought was the guy just invited every junkie into his neighborhood.

    By the time 11 o'clock rolled around somebody must have complained or a producer realized how idiotic it was to broadcasts that information and that part of the clip was not replayed.

    I know of several people in parts of Amherst who have to get their locks changed when they go on vacation or sell because they simply do not know where the keys are.

    Growing up, I never used a key to my parents home in Amherst. I lived in a house for 18 years and never had it locked.


    So ya..people keep the doors unlocked when they are home.
