Instead of wasting time on political grandstanding, Michael Kearns should be focusing on the job taxpayers hired him to do: improving the Clerk’s Office. Lines are getting longer, services and locations are being cut, and rather than focusing on the needs of the customers who pay his salary, Kearns is playing political games with phony issues. There is no bill in the State Senate that would enable undocumented immigrants to obtain driver’s licenses. This issue is going nowhere. The people of Erie County deserve a Clerk who is focused on making their lives easier. This is why I am running for Clerk.

BUFFALO, N.Y. (WIVB) - Erie County Clerk Michael Kearns is taking a controversial stand against an idea being debated in the New York State Legislature.

That plan would give undocumented immigrants the opportunity to apply for a driver's license. Kearns says even if that bill passes the legislature, he won't let that happen.

"We will not process any of these licenses in Erie County," Kearns said. "As straight forward and direct as that, we will not do that."

In April, Governor Andrew Cuomo said this is something that should be decided by the counties. Kearns heard that, and issued his response Thursday.

What is Clerk?

Erie County Clerk Michael “Mickey” Kearns says he’s a Democrat, but he’s just another Trumpublican. He is now taking a cue from Sheriff Tim Howard and threatening to disobey state law. Whereas Howard pledged not to enforce the duly enacted New York “SAFE” Act, Kearns is promising to ignore (if enacted) a proposed law requiring NYS clerks to issue driver’s licenses to undocumented immigrants.

Kearns is Erie County’s clerk; not an Erie County legislator. His job is purely ministerial; he is not given power to set policy, nor is he granted any sort of discretion in performing his duties. His job is to issue licenses, record and file paperwork, and that’s about it. More to the point, there is literally nothing within the clerk’s power that gives him authority over immigration law enforcement.

Undocumented immigrants are people who have by passed our laws and entered the USA illegally. Correct?

Undocumented immigrants aren’t criminals; lack of proper visa status isn’t a crime, it’s a violation of immigration laws and regulations.

So what is a violation versus a crime?

Kearns could lose job over stance on drivers license

BUFFALO, N.Y. (WBEN) - Erie County Executive Mark Poloncarz warned Erie County Clerk Mickey Kearns that the latter may lose his job over his position on drivers licenses and undocumented immigrants.

Kearns, last Thursday, said he will not issue a drivers license for any illegal aliens even if the state legislature or Governor Andrew Cuomo would permit it. The legislature has a bill in committee which would give undocumented people the right to do so. If it fails to pass the legislature, Kearns warned that Governor Andrew Cuomo may issue an executive order permitting it.
