Thread: Town Attorney wondering threw parking lots!

    Double dipping is not extra curricular dealing!

    In response to post quoted below:

    When a person claims to work , receive pay and benefits for a full time job - they are expected to work full time.

    If i paid a lawyer a few hundred dollars an hour - i would assume he worked for me those hours.

    Unless this guy doesn't sleep - how can he possibly do both ?

    Where New York State should be involved is clear - if he is billing law clients for hours that conflict with Town hours - he's defrauding the pension system as well as taxpayers who think he's in Town Hall .(because as most residents know - he is not.)

    If i were a client , i would be suspicious of his accounting practices. Actually all Lancaster Taxpayers are his clients.

    If he recieves compensation from clients that go in front of our Town Board or Planning Board for project approvals - who does he work for?

    If it is in fact is going on, it seems that it is the Supervisor's job to ensure that such dealings are not conflicting with the performance of his duties as a town employee. Unless it's specifically spelled out in his job description/duties, I don't think the town can prevent him from operating his own private practice.

    Erie County's first Highway Superintendent served from something like 1902 to 1933. While the County's Supervisor, he simultaneously served as a private consultant for 26 towns and villages in Erie County.

    Now that was a guy who didn't need much sleep.

    So this town attorney is following in a fine tradition.

    I don't know of a Town Attorney that doesn't have a private practice. I am of the impression that these positions required work to be done and not hours to be clocked. In other words, if work in the town is getting done, why can't the Town Attorney also conduct a private practice?

    Pension is based on job.

    The pension and benefits paid are based on full time hours/position , not on amount of labor performed.

    If work load is all that matters - then why not save thousands of tax dollars by hiring a part time lawyer - without lifetime pension and lifetime health care benefits paid by the taxpayers of Lancaster?

    YOu make a very good point.. Is this the way it is in most towns?

    So what if he does?
    paul clark has a "full time" job in west seneca as the town supervisor, gets a full time pay, yet also runs a "full time" CPA firm across the street from town hall! Must be magic, the skills some of these people have.
