CITIZENS-VOTERS PERMISSIVE REFERENDUM

At the May 18, 2009 Town Board meeting, the Town of Lancaster (TOL) approved bond borrowing resolutions totaling $3.5 million. Chapter 62 of the consolidated LAWS
Article 7 allows for a PERMISSIVE REFERENDUM
Section 91-Referendum on Petition
The 2009-May 21st Depew/Lancaster Bee edition (PAGE 25) posted 4 LEGAL NOTICES for the PROPOSED four BOND BORROWING RESOLUTIONS
Resolution #2 - $ 650,000.00
Resolution #3 - $50,000.00
Resolution #4 - $500,000.00
Resolution #5 - $2,300,000.00 (Renovation / Expansion of Town Hall)
Gross Total - $3,500,000.00
Such bonding will obligate TOL Citizen/Taxpayers and their children and Grandchildren to pay for 20 yrs.–year 2030.
Section 91states that the above 4 TOL BANS WILL NOT take effect until 30 calendar days on JUNE 18th, 2009. This allows time for the entering of a Permissive Referendum where a petition signed by 5 per centum (5%) of the TOTAL TOL VOTE CAST for NYS Governor held in 2007 needs gathering. Approx. 800 *TOL Signatures are required and then delivered to the Duly Elected TOL town Clerk!
We the people can therefore have the duly elected 5 Member TOL board RESCIND, REPEAL the May 18, 2009 Resolution Arbitrarily Approved,
*Please Note! The duly elected TOL Clerk, Register of Vital Statistics, Records Access Officer, Fiduciary ignores, and has not provided the citizens of TOL via regular information request and ignores, the NY state “FOIL”LAW- yes it is a LAW! Therefore we the citizens cannot provide an exact/specific number of legal signatures necessary for the TOL permissive referendum.
**Historic note; on April 1st 2003 this same duly Fiduciary elected TOL board approved the bonding of almost 2million dollar for 3949 Walden Ave. TOL propose public safety center, formerly the Colecraft building or TR complex. The 2003 TOL-Bonding BAN-Resolution was also subject to Permissive Referendum.
The citizens were NOT openly informed of their TOL legal option. Six years later we have a “White Elephant” building complex; unused with over 2 million of taxpayer’s money spent as of June 1st 2009. And, with absolutely no formal, legal plan on how to rectify this huge financial mistake; a political bungle, to say the least.
We the people do NOT intend to have financial lighting strike again. Please sign the citizens Permissive Referendum should the opportunity be presented to you.
