    Federal Judge: Obama's Immigration Action Unconstitutional

    It came up in a sentencing determination:

    The controversial executive action on immigration issued by President Obama late last month is unconstitutional, a federal judge in Pittsburgh ruled Tuesday.

    In a 38-page opinion evaluating the impact of the executive action on the sentence due for a Honduran immigrant who pleaded guilty in October to illegally reentering the country after he was first deported in 2005, U.S. District Judge Arthur J. Schwab of the Western District of Pennsylvania waded into the politically charged waters surrounding the action.

    ...

    Schwab, however, ruled that Juarez-Escobar’s criminal case is inexorably entwined with the civil proceeding during which the decision about deportation would be made.

    “This court, which arguably has no control over the imposition of the ‘deportation sanction’ (which is left to the civil immigration judge via a separate proceeding), cannot ignore the fact that what happens here, in this criminal proceeding, significantly and determinatively impacts what happens there, in a civil proceeding,” Schwab said.

    So, in order to assess the impact of the executive action on the case, he first had to assess the constitutionality of the action itself.

    “President Obama’s unilateral legislative action violates the separation of powers provided for in the U.S. Constitution as well as the take care clause, and therefore, is unconstitutional,” Schwab said.

    Which would make him an "activist" judge, no? I'm surprised he didn't indict Darren Wilson for killing Michael Brown too, as much standing as this ruling has.

    uh.....Duh!

    I guess we needed a Federal judge to tell us that however.

    Dear Mr. President,

    17 million children in the US are in poverty and go to bed hungry at night, Less than half that number are under 6 years of age.


    Do we have to say ANYTHING more? Does anyone? Well, of course not.

    We should take care of our own before opening up the door to millions of people from other countries who would compete in the job market. We should take care of our own children's educational needs before adding millions of children from other countries. Just take the example of the obnoxious property taxes the Cheektowaga Democratic Party has saddled us property/business owners with. Seeing NYS has some of the most costly welfare programs in the USA what if 2000 families decide to locate in Cheektowaga. 2000 families may have 2000 children. For the most part the current property/business owners would have to cover the cost of that. Correct? I really don't think the job market in our area would have 2000 job openings for 2000 families that would relocate here.

    140,000 people is like bring the city a little over 1/2 the size of Buffalo over.

    Who is going to pay for this? Who will pay for housing, teaching and medical care of 140,000 more people?

    Ah...if only we didn't have illegal immigrants...then our property taxes would be lower without any decrease in town services.

    Guess how many refugees Saudi, Kuwait, and other rich Arab nations took? The only reason Arab/Muslim countries take refugees is because they are at their back door. You can bet they would not if the issue wasn't forced. Our children still go to bed hungry.
