    Once again Mr.Chowaniec cuts through the smoke - taxpayer/Resident Mike Fronczak asks civil, important questions and the Town Board waffles and evades straight answers!

    When will they ever learn to talk honestly. They used the purchase of the ColeCraft building as a Campaign Highlight material back around 2002-2003. Like the "Proposed Soccer Fields" were used this past fall.

    It was supposed to be a great bargain and Supervisor Giza excused his ignoring of the rules when he purchased it . He said he, "Had to act fast, other potential buyers were looking at the building." So without formal approval, he signed the deal.(No one else has ever come forward)

    A Judge declared, "While his actions weren't illegal, they were bad Governance."

    He also included over $30,000.00 for the furniture - no one has ever seen a inventory of those items presented by the Town Board.

    $1.9 million, for a empty leaking mold riddled building. Which now contains Town Equipment and in the smallest usable portion, Detectives and their staff. Not a suitable environment for those employees, they deserve better!

    Then Mr.Ruffino claims to be "contacting state reps to get grants to help defray the costs of renovating the Walden Avenue Building. We are looking in any avenue we can to get assistance,” Ruffino declared. “It’s still a work in progress. We don’t want to burden the taxpayers.”

    We the home owners are paying the monthly note on the original $1.9 Million tax dollars.

    We are using tax dollars to pay that note. We are not receiving tax revenue from the building because the Town Owns it.

    We are using tax dollars to pay utilities.

    What happened to the $300,000.00+ tax dollars Lancaster received for renovations. Supervisor Giza said "We received a Grant for that money" - where did that go?

    According to a tax funded study Supervisor Giza had ordered:
    even back then (2003) placed that number somewhere between "$9 and $11 million" to renovate the building.

    Now, after spending Millions of tax dollars the Town Board tell taxpayers:

    Mr. Ruffino declared. “It’s still a work in progress. We don’t want to burden the taxpayers.”

    Supervisor Giza said: “It’s not that we don’t want to do it, we want to take as much burden off the taxpayer as we can."

    Then he adds: "but we just put $7 million (tax dollars) into our water lines which will add to the debt service."

    These "water lines" benefits for the most part - new construction - newer subdivisions - they used tax dollars to subsidize Developers and Lancaster's Home owners will pay the bills.

    Lastly, Mr.Ruffino has never finished one of his promised "Quality of Life Improvements" with out the funding coming from home owners/Lancaster Tax Payers. He hasn't accomplished or initiated one one new service or enhancement. He just piggy backs and takes credit for whats already in place and funded by tax dollars!

    He and Supervisor Giza keep saying, "We don’t want to burden the taxpayers.”

    "Grants, State aid, Federal dollars are all tax dollars."
    The fancy labels don't change the outcome!

    "Debt Service" - is fancy term for
    "You, the taxpayer/home owner will pay these debts"

    I always viewed the LIDA as an arm of the town. It appeared to me to be a conflict of interest for an officer of the LIDA to profit from a transaction (sale of a building) to the town.


    From LIDA's policy manual- LIDA Policy Manual


    Rule with respect to conflicts of interest:
    No officer, member of the board or employee should have any interest, financial or otherwise, direct or indirect, or engage in any business or transaction or professional activity or incur any obligation of any nature, which is in substantial conflict with the proper discharge of

    his or her or her duties in the public interest.


    The situation may not be a perfect fit for the above rule. But before entering into any negotiations both Benzel and Giza should have known how the transaction would have appeared to be a conflict of interest.

    Wink Buddies are supposed to bail out buddies!

    When giving a tour of the ColeCraft building to taxpayers/residents, a taxpayer asked, "Who is Mr.Benzel" -

    He was speaking to Lancaster Town Supervisor/IDA Chairman Bob Giza. The Supervisor replied without facing the person who asked, "Mr.Benzel , not sure, isn't he a truck driver here or something, don't know!"

    Mr.Benzel was the owner of the ColeCraft Building.
    Mr.Benzel was also a Board Member of Lancaster's Industrial Development Agency(IDA).

    The Town Supervisor was the person who handled the purchase for the Town. The Village Mayor was also involve, but was taken out of the loop by Supervisor Giza, Mayor Cansdale complained publicly!

    Supervisor Bob Giza as Chairman of the IDA helped arrange the IDA Package for this purchase. He was the principal agent at the Town Board level and IDA.

    Taxpayers/Residents sued the Town Board over this deal. The Judge said, "This doesn't appear illegal, just bad Governance."

    Some believe the Attorney General or other agencies should have examined this deal.

    A similar case involved the financing of the Old Bocces Building(Save Allot). It was another deal where IDA involvement, and Supervisor Bob Giza made the sale possible. Those involved in the purchase are a group of "Political Insiders." They purchased that property, which includes 11 West Main Street Offices. Some of which are also rented using Lancaster Tax dollars.
    WHO BENEFITED FROM THAT DEAL - NOT Lancaster's TAXPAYERS!

    There is a history in Lancaster -
    an ongoing underground of "Good Old Boys"

    Funded by Property Tax Dollars.

    Robert Benzel of the LIDA,
    past president of Colecraft Manu- 3949 Walden Ave
    past co-owner of Business Accessories/Colecraft Inc/LLC- 3949 Walden Ave
    past officer of TR Manufacturing- 3949 Walden Ave
    had any financial interest in the real property at 3949 Walden Ave when sold to the Town of Lancaster on July 21, 2003?
