Thread: SECTION 305 Property Maintenance CODE of NEW YORK STATE

    SECTION 305 Property Maintenance CODE of NEW YORK STATE

    ALL GARBAGE BAGS (PLASTIC OR PAPER) SHALL BE PLACED IN SUITABLE CONTAINERS NOT EXCEEDEDING 40 POUNDS (GALVANIZED METAL CANS OR HEAVY GAUGE PLASTIC/VINYL) TO PREVENT ANY MATERIAL FROM FALLING OUT. ANY GARBAGE IN PLASTIC OR PAPER BAGS LEFT OUTSIDE OF CANS WILL NOT BE PICKED UP (SECTION 305 OF THE PROPERTY MAINTENANCE CODE OF NEW YORK). FAILURE TO COMPLY WILL RESULT IN FINES.


    The above 305 CODE is from the town of cheektowaga, and the state of NY. Its funny how this rule, law, ordinance is placed on the Town of Cheektowaga Guide to Recycling when the Town doesn't even impose there own rules or laws.

    I have this neighbor who stores all there garbage in there garage for what appears to be for several weeks. At least once per month (mostly) in the summer months you can count up to 20 bags of black plastic bags with no cans all piled up on the grass, and each year the Town garbage people continue to pick up there garbage bags. In CODE 305 its states garbage will not be picked up if not in suitable cans ...... I have done the following .....

    I told the Town , I would be glad to drive around each garbage week in my area only to give out fine notices for uncanned garbage bags for no pay except for a small stipend for my gas ..... The Town looked at me like I was NUTS !!! or someone with all my marbles inside my pocket. I told the Town it's time for volunteerism because this issues needs to end in this Township. I also told the Town you made a law, rule I expect you the Town to enforce this law or to have them remove it from those mailed out Guide to Recycling pan flint to save the town money.

    My last sounding words as I left the Town seat of power saying .....

    "Fine these violators or give up this Town rule."

    What not find out how the current "garbage" monitor is doing. I believe I saw a white car driving around with some lettering on it. If you are willing to volunteer to help our town there is no reason to pay someone to do it. Wouldn't we all agree? Well except for the guy getting the paycheck...

    Maybe call Frank Max and ask how many "tickets" or "notices" were given out for the last 6 months. He should have that computerized in a database somewhere. Lets see how the monitoring is coming along.

    OR You can take pictures of the violations/properties and ask the Town Board why the codes are NOT being enforced at these locations

    I'd think you were a little nuts as well. Why would you waste your time (and money) driving around writing citations for other people's uncanned garbage? Leave that to the guys who are paid to do it.

    I think he's point was that the people who are getting paid to do it, simply aren't! I think idea is great, rather his town have to pay some fool a huge some of money, have people do it on their own time.

    we call them the garage police but i think they only have one right now. at one point there were 2 both jobs politicial ones. the town has been writing the tickets but no fines have been given out, from what i am told nothing is set up in the courts on how to do this yet. max he could careless about tickets the only tickets he is worried about are the politicial ones he sells for the politicians.

    Not to sound like a prick, but seriously, ratting out your neighbors to the authorities over something so stupid just makes you look like an Ahole. And if you ever need help around your own house your neighbors will be less inclined to help you if you start writing tickets out.

    Hoenstly, is your life that boring that you need to actually add more stress and anxiety to other peoples lives?

    Amherst has garbage bins, I have two of them some weeks I cant fit it all in both cans, so what I am supposed to 'store' garbage?

    You're right, in fact the garbage police is a highway worker, and his main job is working on the town highway, not driving around on garbage days lol .... once a month he checks in with garbage lol ....

    I can see by your remarks to me you are narrow minded if you have to use the statement 'ahole' to me....When neighbors don't follow the town lawes it effects my property and my other neighbors property; therefore, I wont wast my breath explaining anything more to you.

    Yanno, I would have agreed with you before I got a nasty gram in the mail. We went out and bought new cans with lids. I looked around the next garbage day and most of the people on my street just put bags at the curb--not even in a can. Then the garbage men very nicely tossed the lids separate from the cans so I lost a lid on the very first week we had the new ones.

    I called and asked why all my neighbors weren't cited as we were. The woman I spoke with didn't have an answer.

    There isn't any sanitation police anymore according to the last budget! Its up to the housing dept to enforce the law from here on in.

    Of course they don't have an answer It was probally her brother-in-law who tossed your lid.
