ALL GARBAGE BAGS (PLASTIC OR PAPER) SHALL BE PLACED IN SUITABLE CONTAINERS NOT EXCEEDEDING 40 POUNDS (GALVANIZED METAL CANS OR HEAVY GAUGE PLASTIC/VINYL) TO PREVENT ANY MATERIAL FROM FALLING OUT. ANY GARBAGE IN PLASTIC OR PAPER BAGS LEFT OUTSIDE OF CANS WILL NOT BE PICKED UP (SECTION 305 OF THE PROPERTY MAINTENANCE CODE OF NEW YORK). FAILURE TO COMPLY WILL RESULT IN FINES.
The above 305 CODE is from the town of cheektowaga, and the state of NY. Its funny how this rule, law, ordinance is placed on the Town of Cheektowaga Guide to Recycling when the Town doesn't even impose there own rules or laws.
I have this neighbor who stores all there garbage in there garage for what appears to be for several weeks. At least once per month (mostly) in the summer months you can count up to 20 bags of black plastic bags with no cans all piled up on the grass, and each year the Town garbage people continue to pick up there garbage bags. In CODE 305 its states garbage will not be picked up if not in suitable cans ...... I have done the following .....
I told the Town , I would be glad to drive around each garbage week in my area only to give out fine notices for uncanned garbage bags for no pay except for a small stipend for my gas ..... The Town looked at me like I was NUTS !!! or someone with all my marbles inside my pocket. I told the Town it's time for volunteerism because this issues needs to end in this Township. I also told the Town you made a law, rule I expect you the Town to enforce this law or to have them remove it from those mailed out Guide to Recycling pan flint to save the town money.
My last sounding words as I left the Town seat of power saying .....
"Fine these violators or give up this Town rule."
