I guess you kinda gotta. But damn...can you imagine the liability if something like this happens again and he's found guilty? It would be a miscarriage of justice if he loses his job for something he was found not to have done. I think if I were his supervisor, I'd steer him toward some sort of "more lucrative" position that didn't involve him being individually responsible for prisoners. Kind of CYA on both sides there.

I know the kid was a POS, but something about Avery's story was off kilter too.
If that kid was a model citizen I think I'd be more inclined to believe him. Avery's attempted suicide, and the fact that some others came out and said he had threatened them makes me suspicious.

I'm not saying I think he was guilty, I'm just saying I wouldn't be happy if Avery were my kids camp counselor...

    Wink

If you ever saw him and Gale Denn together, you would know he's guilty! Just ask the people of North Collins.

Couldn't the Sheriffs department give George Avery a desk job where he doesn't have to deal with the public.

From what I heard on the radio Mr Avery may be sued in a civil court by the same person that brought criminal charges against him.

Innocent until proven guilty.... he wasn't proven guilty therefore, he is innocent. Those are the rules that were established long ago. Unfortunately, things have become guilty until proven innocent and even when someone is found not guilty people still believe they are guilty.

None of us were in the court room, so we dont know all of the details. Give the guy his job back!

I suppose you don't have an opinion on OJ?

If he gets his job back the least they can do is let us know where he'll be patrolling. The only people that will speed or drink and drive through his sector will be Boy Scout Leaders, Priests, and Congressmen.

OJ probably did kill Nicole and Ron, but he was found not guilty. He has been all over the place since the trial and he hasnt killed anyone else.

There was a lot more to that case than this one. The details of that case were highly publicized. This case doesnt even compare. Criminals make all sorts of complaints about the police. Some are legitimate and those who are guilty are found guilty. Obviously there were a lot of discrepancies in stories which led to the not guilty verdict. You can't keep the guy off the force because he was not guilty! That has got to be illegal. Can you imagine if someone said you molested them. You go to court, you are found not guilty and then are told you cant have your job back because someone accused of something? That is the most ridiculous thing I have ever heard of!

The fact that the kid was a drugged out scumbag with a long history of being a scumbag and a liar gave him no credibility what so ever.

That has nothing to do though with the fact that Avery tried to kill himself and that others came forward and said Avery threatened to do to them what he was accused of doing to the scumbag.

The court of public opinion is a powerful thing. Just not more powerful than the real court and the ECSD union! He'll be back at work unless there is some thing that prevents a person that attempts suicide from carrying a fire-arm (perhaps he'll need a psych eval?).

Don Esmonde article was very interesting. How John Cleary an investigator in the District attorney's office was allowed on the Avery case after Avery had arrested Cleary on a drunken driving charge in 2003. This alone should be grounds for an investigation.
