Police commissioner cautions against resisting armed robbers

Buffalo’s top cop is warning residents to avoid confronting armed robbers after two robberies involving victims fighting back.

One incident happened Monday night inside a hardware store when a robber fired a bullet into the ceiling, and the store owner and a customer retaliated by wrestling the gunman to the ground, knocking the gun out of his hand and holding him until officers arrived.

The other involved a store employee hurling beer bottles at a gunman who was spraying bullets inside a Bailey Avenue convenience store Sunday.

“We’re very fortunate that no one was seriously hurt,” Police Commissioner H. McCarthy Gipson said at a news conference Tuesday afternoon.

“We at the Police Department are not recommending these types of responses. He could have been shot or killed lobbing those beer bottles,” Gipson said. “We are always concerned about people taking the law into their own hands. I don’t want to see people try to overpower a weapon.”

Gipson advised victims of robberies to leave the situation, get out of harm’s way and contact the police.

“The overwhelming goal is to survive,” the commissioner said. “Your life is more valuable than the dollars you may have earned.”

Monday night, a Roslyn Street man tried to rob a hardware store at gunpoint, but his plan was thwarted when the store owner and a customer tackled him to the ground, Buffalo police say.

Christopher G. Russell, 33, was charged with attempted robbery, reckless endangerment, menacing, criminal possession of a weapon and criminal use of a firearm.

Two male accomplices are still being sought.

Three men entered Northland Hardware, 508 Northland Ave. near Fillmore Avenue, at about 6:10 p.m., Buffalo police spokesman Michael J. De- George said

The store owner, Nathaniel Fountain, and three customers were inside the store at the time.

Police say Russell held up a .22-caliber revolver, ordered everyone to get on the floor and then fired a single shot into the ceiling.

“The suspect had his hand in the air with the gun,” said De- George. “A customer standing near the suspect reached for him, a struggle ensued, and the owner also jumped in. The suspect was caught by these people.”

The two others fled on foot. Northeast District Lt. Thomas Leatherbarrow and Officer Aaron Young arrested Russell at the store. The officers also recovered a .22-caliber revolver, which the store owner and a customer had knocked out of Russell’s hand, according to police.

Russell was treated in Erie County Medical Center for injuries suffered during the struggle and then was taken into police custody.

Is there any reason why so many folks are resisting these robbers now? Has it always been this way? Or is it just due to the shopkeepers that were shot last year even if they complied with the bandits demands, so people who get mugged basically have nothing to lose by trying to fight back?

I hope they throw the book at these punks when they are hauled in to court.

    I personally would fight back....

if you lay on the floor and let the scumbag stand over you with the gun, you've essentially got a 50/50 shot of being murdered

I'd rather go down fighting than lay down and get shot in the back of the head

Knowing these thugs have little disregard for human life, I would take my chances defending myself. If I go down..at least it wont be at the Mercy of some punk

    Exactly.

Maybe it's time to do a few reviews on home protection devices.

If its a situation where you cant get to the gun I wouldnt jump for it, and if you dont have a gun I wouldnt wrestle someone for it, that is NOT a good idea.

A police commissioner who tells people not to defend themselves? This guy is a tool. I guess it makes sense in a state like Yew Nork where concealed weapons permits are damn-near impossible to obtain.

"You don't need a gun! Buffalo's finest will protect you, union contract willing."

I'd rather be on probation for carrying an unlicensed weapon than depend on the fools known as the BPD to protect me. At least I don't need to brandish my weapon to be respected.

I know a couple of those kids, they're actually just punks. The likelihood that they would shoot someone is close to 0%. That being said, hindsight is always 20/20. Especially now that I have kids of my own, I don't care so much about dying myself, but of course I worry about their future. That's why I might not risk fighting over the contents of a cash register. However, were someone threatening my family and if it were me or them...there'd be no question I'd take the bullet.

    Regards.

Not me. I'd have a better chance of living if I open the cash drawer and told a gun to help itself. If he tried to touch me (my body). That's a different story. He'd be sliced with a dirty razor blade. Kill me or not. He'd have an infection he'll never forget.

When a cop tells you to do something, theres a reason for it.

    Dont be a hero.

Do what they want and most likely you will live.

    Are you kidding me?

Every person has a right to defend themselves. Last I heard, using deadly force to defend against a violent felony is legal in all 50 states.

How do you expect me to protect myself when someone's pointing a gun at my head? My good looks will only get me so far

don't rely on Cops to protect you

there are way too few of us. As well, we are largely reactionary. We aren't fortune tellers. Buy a gun if you feel the need. Learn the laws that apply. Very few people will ever be put in a situation that they will need it for protection, but if it gives you personal peace of mind carrying one, so be it.

You forgot one: learn how to shoot the gun! Too many people buy handguns and don't learn how to use them safely and effectively

The whole notion that "I would" or "Would not" protect myself is situationally dependant. How can you say with certainty what you would do at any given point in time?
I've had a gun pointed at me. It's some scary ****. I've had a knife pulled on me as well. Scary **** as well, but not nearly as scary as a gun.
To say definitively what you'd do one way or another is total BS. You just don't know until it happens.
