On his show today, TB was trying to make the point that eyewitness testimony is the least reliable (an assertion that is correct.)
But he did so using what he depicted as a first day "criminology class" event used in many criminology courses.
TB claimed that a criminology teacher will ask the class if anyone "has a gun" and if no one raises their hand then he will signal a plant to carry out the "experiment."
at sometime during the class, a person bursts into the room and starts firing a gun at the teacher. the gun is "loaded with blanks." The teacher falls to the floor as if shot, and after the assailant leaves the room, he gets up and informs the class it was a fake staged event. then he asks the class to describe the assailant to prove how faulty their observation skills are under stress.
TB's idiotic scenario fails to take into account that most people who are legally armed wouldn't let anyone know. Even if asked by a college teacher.
someone who is legally armed might feel in danger from the situation, draw their weapon, and fire a "non-blank" and the actor, causing a justified tragedy.
TB needs to think these things through better.

This is why that teacher wouldn't work in the real world. They would forget to ask if anyone in class has a throwing knife strapped to their lower leg. Think of the look of the teacher when the person who shot the gun falls back with a knife in the middle of their forehead.
So technically who is at fault and who would get sued?

Actually, the technique that is sometimes used to demonstrate unreliable eyewitness testimony, involves a thief who steals something, not a man firing a weapon at a teacher. As another poster indicated, all because nobody admits to ccw doesn't mean somebody won't pull out a gun and kill the actor in a moment's notice. THAT is why this scenario is BS. A common purse snatcher would not (likely) be fired upon by anybody(except maybe TB).
