    Clarence temporarily halting Multifamily development

    “A Temporary Moratorium on all future proposed
    Multiple Family Residential Developments within the Town of Clarence, New York”

    Section-I: TITLE.
    This Local Law shall be known and cited as Town of Clarence Local Law No. 2 of 2017 entitled
    “A Temporary Moratorium on all future proposed Multiple Family Residential Developments
    within the Town of Clarence, New York”



    Section-II: PURPOSE AND INTENT.

    A. It is the intention of the Town Board of the Town of Clarence in enacting this Local Law to
    temporarily suspend future proposed Multiple Family Residential Developments within the
    Traditional Neighborhood District, Restricted Business and Commercial zoning classifications,
    as defined in Section IV herein, by the imposition of a temporary moratorium on the issuance of
    permits and approvals for such uses for a period of 6 months from the effective date of this Local
    Law. Provision is made in this Local Law to allow for extension of the 6 month moratorium if
    necessary.

    B. The purpose of this temporary moratorium is to enable the Town of Clarence to temporarily
    halt all future proposed Multiple Family Residential Developments for a reasonable period of
    time to enable the Town to adopt appropriate regulations relating to Multiple Family Residential
    Developments within the Town.

    C. The Town of Clarence recently adopted Clarence 2030, a Comprehensive Plan that provides
    an overall framework for future public and private investment while serving as the foundation


    D. Within Clarence 2030, the Economic Development and Hamlet Revitalization Goal statement
    identifies that the Town will manage and pursue investments, both public and private, that
    promote sustainable economic growth throughout the Town. The success of the local economy
    relies on the commercial, office, and industrial investments located throughout the Town, as
    these operations provide opportunities for employment, tax revenue, and growth. Over the next
    decade, the collection of businesses located throughout the community will continue to be a
    primary source of economic activity. While the Town Board identifies the need for multiple
    family residential development, the balance of uses to ensure protection of the various
    commercial zoning classifications is essential.

    E. The Town of Clarence recognizes that Multiple Family Residential Uses have many benefits
    to residents and the community at large but wise and thoughtful regulations regarding the
    location and intensity of specific types of such uses are required.

    F. The temporary moratorium on all future proposed Multiple Family Residential Developments
    is within those Zoning Classifications that currently allow for such uses via the Special
    Exception Use Permitting process.

    G. During the period of this temporary moratorium, the Town Board intends to suspend land use
    regulations in the Town Code which conflict with the effect and intent of this Local Law.

    They can't do this. They are blocking the right of lower income people to live in Clarence. What if someone who owns property in Clarence wants to build a multiple unit subsidized apartment complex?

    Isnt this exactly what they're trying to prevent??
    But...on the flip side...there are well educated upper middle class and upper class professionals who have worked hard...paid for their education, as in any area of the country...that have EARNED their place in society...enjoying the fruits of their hard earned labor....mean while..a socialistic govt entity wants to put a highly subsidized housing development in their backyard? ...to enjoy the same fruits/rewards that someone who has worked hard to earn in society...as opposed to the handouts that those low income individuals will also enjoy with out any effort? on their part.
