If there was a provision in Kaminski's Contract of Sale with the church that the land goes back to Kaminski if the church did not get their plan approved by the town board, there is a problem. These types of clauses are in all contracts of sale when this type of project needs a board's approval. It would be unethical, illegal and absolutely against the law that Kaminski voted on it. People have gone to jail across the country for profiting off the taxpayers. It's pay to play for his vote and anyone else that voted for it.

They usually are in all contracts, but not for Churches..Im sure if you would have been at the informational meeting with the churches attorney you would have found out that there is nothing the town can do to stop them from building. If the whole town board voted against it, it would still get built. In New York State Churches are exempt from zoning laws. They have to adhere to environmental, building plans, etc., but can not say you cant build a place of worship here.

I am so glad you were at meeting with the church's lawyers but why would anyone take the word of the church's lawyers? They really don't care if Kaminski illegally voted on the project. The church's lawyers just care about getting their deal. What worries me is that vote violates state and federal laws on profiteering for a councilman and is a federal offense.
It must have been that honest and ethical church's attorney, Ralph Lorigo, who is also chairman of the Erie County Conservative Party. Just like he told them there is nothing the town can do to stop them from building.=grump;1696115

As he did with Tim Horton on Dick Rd, Lorigo would have threatened legal action and the board who last week has hired the old town attorney back on a part time bases may have fought it unlike when they caved to Lorigo over the Tim Hortons deal due to the then newly hired part time attorney's recommendation.
So, there may not have been any legal console to advise the board before the vote last week.
You know the way the Cheektowaga Democratic Party has used money in the past with lawyers for employee issues you would think this wouldn't be an issue. Kevin is cool at least any time I dealt with him. Sometimes you do have to step up to the plate and not cave in.

It's actually Alice, Rogowski and Meyers whose seats are up. I'm willing to bet if Pat Delaney had beat Alice last year we wouldn't be having half of these problems.
