    Did you contact Building Inspector Matt Fischione to apprise him of the structure going up and ask if there was a building permit issued; whether there is a court appearance ticket issued because of permit violation; or whether the applicant hired a lawyer to sue the town on the basis of what he believes is proper zoning.

    As the property owner withdrew his site plan application I remain confused as to why a property owner would invest time and money on a project that may have to come down.

    Lastly, wasn't there already some operation taking place on the property which required 'special use' but that he now wants to expand that business?

    At last night’s town board meeting, by unanimous vote the board rescinded an agreement made in December of 2015 with Sand And Gravel, Incorporated to take its brush and compost as it did not get the required permits to conduct such an operation along with its mining permit.

    In addition, this writer asked on the property owner erecting a dwelling on the property and having a building permit to do so. No permit was issued and a stop work order was issued by the Building Inspector.

    The town is doing its part in regulating and enforcing the codes on this property (31 Peppermint Road). Should the property owner seek legal recourse it would appear to be a lost cause. The shed was to be used for shredding topsoil and no required special use permit has been granted.

    The lone permit granted is for the mining of gravel and sand.

    His operation should be shut down and he should be cited and fined.

    That would require the Code Enforcement Officer to do his job and shut him down.

    Basically the CEO did, and now it is in the hands of the court system. There is a process..a long one....
