Public entitled to see videos of cellblock attack, open government expert says

The Buffalo Police Department has the discretion to release videos of a city cellblock attendant attacking a handcuffed prisoner as two police officers watched, but police officials and Mayor Byron W. Brown reiterated Thursday that the videos will not be released until a federal investigation and trial are completed.

The continued refusal to immediately release the videos comes as the state’s top freedom-of-information official says release of the tapes would not harm the government’s case.

“The public has the right to be aware of the conduct of government employees, particularly when an employee is the subject of criminal charges,” he said.
If the person wasn't a public employee would the video have already been on youtube?
