    Court rules for the voters

    Ruling upholds West Seneca downsizing timeline.

    As of Jan. 1 the West Seneca Town Board will have only three members - two councilmen and the town supervisor -State Supreme Court Justice Donna M. Siwek ruled this afternoon.
    In a dispute that could be considered by the state's higher courts later this month, Siwek upheld the town's contention that the June 3 vote that overwhelmingly backed a plan to downsize the board took effect immediately, putting off Town Board elections until 2011.
    The judge gently chided the State Legislature for leaving the laws affecting such special-election cases for municipalities unchanged and not completely clear for the past seven decades.

    In a victory for West Seneca Town Clerk Patricia DePasquale, the judge dismissed a lawsuit launched by Daniel T. Warren, a politically active West Seneca voter, and David Monolopolus, the only avowed candidate for the Town Board this year.




    Voters do have a voice when they stand united regardless of Party Affiliations.

    Dan Warren posted a press release this morning that said they will not be appealing that part of the decision. I was not aware that there were other issues being raised - like the stipend for the Town Board members and Town employee policies. So if Dan Warren wins on the other issues, that would save the taxpayers a lot of money apparently, because he seems to be exposing some of the tricks that the Town uses to make sure everyone's pockets keep getting lined (at taxpayer expense of course).     Lightbulb Yes , he has good points

    I also have to say, parts of the suit that weren't totally exposed are valid and will serve taxpayers.

    I didn't mean to infer they wouldn't. Many people were concerned that the over riding issue was stalling the downsizing.

    Some times its hard for us on the outside to see throught the smoke. I to appreciate his efforts on behalf of taxpayers.

    Maybe future suits should be posted before the media plants their version of the issues!
