    Governor Paterson must carry out his duty to collect taxes from non-Indians on Indian

    Regardless of what the Governor does with the bill recently presented to him, the policy decision to collect these taxes have already been made by the State Legislature. The Governor and his Tax Commissioner took an oath of office to faithfully execute all laws. It is time that they perform their Constitutional and statutory duty. In the words of District Attorney Swinehart "I\'m at a loss as to how people who are supposed to enforce the law can look the other way. I couldn\'t do it, and DA Budelmann couldn\'t do it."

    Two Questions

    If I travel abroad does NYS collect taxes on my purchases made abroad?

    According to the link the state is attempting to make it illegal for wholesalers to supply the Indian nations. How is this not an unfair attempt to restrict interstate commerce? NYS would have no right to demand tobacco shipped across its roads to other states pay a tax. Why can it attempt to get away with this here?

    Im nuetral on the whole issue but your argument doesnt really hold water.

    The Governor has the power to commute death sentences, repel laws etc.

    Thats why there is an executive branch.

    Actually that power is only bestowed upon the governor after conviction according to the NYS Constitution:

    Article IV § 4. The governor shall have the power to grant reprieves,
    commutations and pardons after conviction, for all offenses except
    treason and cases of impeachment, upon such conditions and with such
    restrictions and limitations, as he or she may think proper, subject to
    such regulations as may be provided by law relative to the manner of
    applying for pardons. Upon conviction for treason, the governor shall
    have power to suspend the execution of the sentence, until the case
    shall be reported to the legislature at its next meeting, when the
    legislature shall either pardon, or commute the sentence, direct the
    execution of the sentence, or grant a further reprieve. The governor
    shall annually communicate to the legislature each case of reprieve,
    commutation or pardon granted, stating the name of the convict, the
    crime of which the convict was convicted, the sentence and its date, and
    the date of the commutation, pardon or reprieve.

    if you bring it back into NY there's a line on the income tax form to pay tax on it

    What really boggles my mind, is that NY is a democratic state, with the 2nd, if not the first, with the highest taxes in the COUNTRY. Yet now we have a democratic congress, senate and white house, and people think our taxes will be lower!? Just look at NY to see what the rest of the country is going to endure in the future with a democratic majority controlly everything.

    Now, aside from that, do INDIAN made smokes fall under this clause? Because I dont smoke non indian made cigarrettes.

    NYS should CUT it's spending instead trying to increase revenues for it's pork. Cut the wages of those in government to no more than $20,000 a year. Make them and anyone else in government pay entirely for their own health care. Pensions, end them yesterday. Let's start comparing salaries and costs to other political filth throughout the world like the salaries and costs being compared to in the manufacturing industries. Let's cut the work force in state government by 60%. Outsource governmental jobs to Asia.

    Taxes are too high in this state. Trying to collect more taxes because state government made up their own rules and laws in order to ignore Indian Sovereignty and rip off tribal profit to feed their insatiable appetite is nothing more than more of the same from NYS. This state has a cancer that will destroy everything it consumes and it is called government. Until this cancer is cut out and eliminated, this state will continue it's death march down the toilet.

    Indian nations and tribes situated within New York are considered part of the State of New York and they are New York citizens. So when one ships to an Indian reservation within New York they are shipping to New York.

    DR. you need to stop drinking! Even NYS knows there REAL problem they will never fix it! They want MORE and not less, that's why NYS has so chance with the NYC DEM's running this state!

    Taxes are to high in this state. We should reduce welfare benefits. Those that fell their welfare welfare benefits are to low, can consider moving to another state. Let us pay the civil servants the same wages and benefits that the taxpayers in New York State get. Outsourcing government jobs would be an excellent way of controlling costs.

    Until taxes are cut NY State is doomed.

    Sadly, the unions, special interests, et al. are going to continue to drive this state into the ground,, and it will not stop until the state is dead,, either bankrupt or people and the private sector gone.

    You would think that was their plan all along.

    NY would rather move businesses and taxpaying citizens out of the state rather than cut waste and reign in spending.
