Court Rules Boy Must Pay Child Support to His Rapist

"I couldn't believe that our son has to pay child support to his abuser."

I've previously discussed cases where boys who have been statutorily raped by older women are forced to pay child support to their rapists. Here's a new one, from Ohio. From Boy's parents sue to get his baby from mom, 21 (Columbus Dispatch, 8/16/08):

LANCASTER, Ohio --- A Pickerington couple and their son are fighting for custody of a baby born to a Lancaster woman charged with having unlawful sex with the boy, who was 15 at the time of conception.

A paternity test shows that the teen is the father of the baby born April 7 to Jane C. Crane, who was 19 when she became pregnant. Now, a judge has ordered him to pay $50 a month in child support and set visitation at seven hours a week.

Crane, meanwhile, faces criminal charges. A Fairfield County grand jury indicted her last month on two counts of unlawful sexual conduct with a minor, a fourth-degree felony. Conviction carries a maximum sentence of 18 months in prison and a requirement to register as a sex offender for 25 years.

Crane is living with the baby and her family in Lancaster.

The boy's parents say they can provide a better upbringing for the baby than Crane can. Her household includes her stepfather, David L. Jacobs, who was convicted of domestic violence last year for hitting, choking and pointing a gun at Crane's 17-year-old sister and was placed on two years' probation, court records show.

"We don't want to have our granddaughter abused by these people," the boy's father said. "We are trying to do the right thing.

"The child support was the icing on the cake. I couldn't believe that our son has to pay child support to his abuser."

Note also that the boy is allowed only seven hours a week of "visitation" with his son. He's really getting an early education on the joys of the family law system...

[As an aside, I don't believe a 19-year-old having sex with a 15-year-old should be statutory rape. However, legally in this case it is statutory rape--just as it would be if it were a 35-year-old with a 15-year-old--so demanding that the victim pay child support should be out of the question.--GS]

ok I think he willingly had sex with this woman - regardless or not if the state says she was raped and she really wasnt???

he should be paying child support - sorry to be such a downer here - I really think he willingly had sex with this woman............................................. ..... rape is not a nice thing obviously - i am wondering if this boy has any nightmares about the sex in question? I dont thinks - but hey, you never really know.

He or his parents want the child - but they dont want to pay for any support? wow - they will really look great in family court......................

I thought it was obvious that the sex was consensual, but what this story showcases is how all humans are not the same.

I'm wondering if child support safety net laws were to vanish, what would happen to the pregnancy rate of unwed mothers? Would it go up, down or sustain? And why?

This irks me. If the tables were turned and it was a 19 year old boy with a 15 year old girl, people would be screaming to have the boy's head on a platter. But since the "woman" in this case was older it's all good?

Granted, when I was 15, I wouldn't frown on having a roll with a 19 year old, but he can't be held financially responsible for something he wasn't legally able to consent to.

well that's an interesting point - however he is or wants or his parents want visitation, so that in itself should require some financial responsibility from someone

At age 16 you can, legally drive/own a vehical that weighs up to 15,999lbs. Which is quite large. You can kill and hurt ALOT of people with it. You can cause THOUSANDS of dollars damage with it. You can have it, drive it on public roads, putting countless people in 'danger' by your inexperience to handle such a large vehical.

However, this is all fine and dandy.

at age 16, you are NOT legally old enought to have sex with your girl friend/boyfriend.

You are NOT allowed to 'enjoy' yourself. Yet you can have this vehical of death and drive it all you want.

NYS age of consent is 17. If you are 16, and she is 17, she can face actual criminal charges! Even if your in the same grade, same classes in HS.

Sex, is a 'dirty' word in our society. While I think sex with young people is wrong, say 10yrs old... sex amongst teens and their peers, how is that bad? Honestly... While one may end up getting pregnant, both parties are liable for the care taking of that child.

Maybe if we as a society removed all the safety nets so that those who get pregnant cant afford the child fail, maybe we would have less teen pregnancies?

Not only that, but what 15yr old boy would honestly turn down sex with an older woman? And how can our society label her as a predator? I never understood this and feel its 'wrong'

I remember a Typing teacher when I was in 11th grade.Man she could have raped me all day. I am sure this young fella will be more tramatized with the out lay of cash then the original lay.

For many women that is exactly what it is about....a check.. and there is no way to ascertain or control how the money is supposed to be spent on the kids..

Look at how people use welfare as income.. some mothers do the same thing.
