Governor Paterson’s mantra on the issue of less than equal enforcement of New York Tax Laws on gas and cigarettes has been that "we must fundamentally change the way we approach these problems." One of the basic principles of equal protection jurisprudence is that a law must be enforced equally on all upon which it applies or on none at all.

DEMOCRATS APPLAUD EFFORTS OF CAYUGA AND SENECA COUNTIES TO ENFORCE TAX COLLECTION ON CIGARETTES SOLD TO NON- INDIANS AND URGE SIMILAR ACTION LOCALLY
Utica, NY – Michael J. Hennessy, Minority Leader of the Oneida County Board of Legislators, along with Democratic County Legislators Frank D. Tallarino (D-7), Edward C. Stephenson (D-3), Michael Clancy (D-12), and Chad Davis (D-18), Larry Tanoury, Jr. (D-25), Joseph Furgol (D-27), Frank Puma (D-1), William Goodman (D-13), Shannon Scott (D-22) and Martin Kernan (D-11) today applauded the actions taken yesterday by officials in Seneca and Cayuga Counties to finally step up and enforce the tax laws of this State. The Democratic Legislators released the following statement:
“We have in the past discussed taking this very action that these two counties took yesterday. However, many local elected officials have worked to prevent this from happening. Today we recognize the efforts of the Cayuga and Seneca Counties, and we especially appreciate the efforts by their respective District Attorneys and law enforcement officials in taking this courageous action. We also want these counties to know that are not orphaned children in this fight and that they do not stand alone in their efforts to enforce the laws of New York State. We stand with them in this and recognize that this must happen throughout this State.”
“We encourage Oneida County Executive Anthony Picente and Madison County Board of Supervisors Chairman John Becker support the actions taken by Seneca and Cayuga Counties and seriously adopt a policy that reinforces these same actions in Oneida and Madison Counties.”
“Finally, we once again invite this Governor to visit our local area to better understand the depths of the tax problems we face here and the crucial need to enforce the laws by which all other businesses must abide. We hope that he will recognize the importance of this enforcement to level the playing field for all local businesses and provide equality and justice to the entire tax paying community in Central New York.”
