    Buffalo Cop Arrested for waving gun around

    Officer Mitchell J. Thomas, 38, of Montcalm Street, is accused of pointing and waving a gun, Buffalo police reports said.

    In February. Finally suspended last week. Awesome

    And he got charged with 3 counts of Menacing, likely menacing in the 2nd degree a class A misdemeanor.

    § 120.14 Menacing in the second degree.
    A person is guilty of menacing in the second degree when:
    1. He or she intentionally places or attempts to place another person
    in reasonable fear of physical injury, serious physical injury or death
    by displaying a deadly weapon, dangerous instrument or what appears to
    be a pistol, revolver, rifle, shotgun, machine gun or other firearm; or
    ...
    Menacing in the second degree is a class A misdemeanor.
    If you or I had waived a gun around outside a nightclub and threatened to "shut it down" while screaming obscenities and pointing a firearm at people do you think we would get the same consideration?

    And folks wonder why many law-abiding taxpaying citizens have such a dim view of the BPD.

    I still have a lot of respect for BPD but as with any organization, there are bad apples in the bunch.
