Nepotism & Federal Law
Nepotism is the act of favoring relatives. Title 5 of the Code of Federal Regulations addresses the issue of nepotism within the government and makes certain provisions to eliminate it.
Application

The federal law that restricts nepotism applies to all members of the executive branch of the federal government as well as positions in the judicial and legislative branch that are subject to civil service laws.

Violations


The Code of Federal Regulations specifically prohibits a public official from hiring or promoting a relative or a relative of a higher-up official. Also, it is illegal for a public official to actively or indirectly endorse a relative's appointment or promotion.

Purpose

This is in place to ensure the federal government is run by competent, qualified individuals. If public positions were given as personal favors, the best interest of the people would be ignored.
