    NYS needs to quadruple the tax on liquor also, just think of all the lives that will be saved, Ha

    Not so fast

    The Indians are far from surrendering - legally or other wise.

    First question I have is this:

    If NY State does collect the sales tax - will it in anyway reduce the average tax payers future debt?

    Will NY State all of a sudden reduce spending in any way?

    Now, personally I believe what ever the Indians can earn they should keep.

    Many other groups/races/ and so on have sued America for reparations - like war time detainee - colored and so on!

    What if the Indians in this day and civil rights era - started a reparation based lawsuit. Class discrimination, war crimes, loss of rights under our constitution and so forth! ?

    Do you people honestly think they are going to go back to being drunks(alcohol sold by the white man) and return to their Te PE's ? !

    The Politicians are just spending millions and millions feeding this lawsuit. Many of those who are crying to tax the Indians have and will make careers and fortunes doing so. The big tobacco companies are driving this fight - not for the tax payers but to gain a larger portion of sales to addicted cigarette smokers.

    So regardless of how we feel because we want them to share our pain - it wont help NY - it wont help us tax payers and it will cause most likely another group to sue and eventually leave NY State and take the millions in tax revenue from their casino's with them.

    Who wins??? Please tell me how !(no pun intended

    Tribal manufactured cigarettes sold to non-indians are taxabable as well. Plus they will have to comply with the MSA.

    but if the state is collecting the tax via taxation of the wholesalers how would they collect on Seneca manufactured cigarettes?

    If the treaty truly says that and it means what you say it means why did the Senecas not rais it in their motion for a preliminary injunction? Because it does not say or mean that.

    so all of this is for how many Senecas If I remember right isn't there only a few thousand of them. and a few hundred that the taxes actually might help people keep saying Nation like it means a large group there are not enough Indians on the res to make a small town. if they really got all that money from the tax free cigarettes then every Indian would be a millionaire the cigarette sales go to a few tribal members only drive through there the rest still live in poverty. little would change for them if the cigarette sales stopped

    Maybe the Indians will circumvent the situation by selling cigarettes manufactured on tribal land. But I doubt thats going to save them. I've sampled their brands, and dont like the flavor/taste very much.[/QUOTE]


    If they are smart they will work on the quality of their product. If die hard smokers can save 44 dollars a carton they will adjust to Indian brands if the quality and flavor even come close.
    Then the goverment will find another reason to go after them.

    I think the treaty says the states do not have the right to deal with the Senecas at all in terms of taxes and land sales etc. Only the Federal Goverment has that right.
    There fore New York taxing them is illegal.
    At least thats what I get out of it.

    New york would have no revenue problems if they legalized pot and taxed that. None of the states would.
