    Excellent suggestion - if it MUST be in West Seneca, however, I still believe this project should be put in the city of Buffalo. Canisius prides itself on being a long-standing Buffalo institution, why they feel the need to "sprawl" is beyond me. There's plenty of crap in the city that needs to be demolished and replaced with something useful - this, in my humble opinion, would be perfect.

    Tell me who wouldn't sell the town something if it would benefit them? The situation with Canisius has absolutely NOTHING to do with the sale of gym equipment.

    You obviously have a personal vendetta against Don Grasso, which really puts your posts off-topic - perhaps you would like to start another thread pertaining to that issue.

    If it's adjourned, then why are the construction vehicles still hanging around the site? Something about this whole thing seems a little off.

    When we filed this proceeding/action we asked the Court for a temporary restraining order pending the hearing of our case that would have prevented them from going forward with construction. The Court did not grant our request for a temporary restraining order and they would not voluntarily cease construction. I did advise them that they are proceeding at their own peril since no rights vest in a landowner under an invalidly issued building permit and if we won Canisius would be compelled to return the land to the way it was before the building permit was issued.

    Canisius did not go into this situation blindly.

    It is a valiant effort, but in the end, I believe Canisius will prevail.

    You are right they did not go into it blindly, they went into it with arrogance and hubris. Paul Clark may be an alum, but he is not the judge in this case Justice Devlin is and she is not an alum.

    It's cheaper for the "connected" to build over grass instead of removing something and building.

    I have submitted to Justice Devlin a proposed order to show cause and supporting affidavit. I am seeking to hold the Town and Canisius in contempt of court, a default judgment against them, to disqualify the law firm of Harris Beach from representing Canisius in this matter because they have an interest in a key witness (HB Cornerstone Partners) and the issuance of subpoenas to the firms that did work on the planning and SEQRA submission for Canisius.     I really don't know what all this means, and though I believe your endeavor is motivated, somewhat understandably, because it is in your back yard, I wish you were around when we all got hoodwinked in town on the soccer complex that you, me and our fellow residents are now footing the bill for, after Paul Clark stated it would pay for itself.

    In short what this means is that the court ordered the Town and Canisius to file and serve their answer to the petition, if any, by September 4, 2007 and further directed the Town Respondents to file and serve a certified copy of the record of the administrative proceedings by September 4, 2007.

    Since Canisius nor the Town did what the Court ordered them to do or willfully resisted the Court's order I am asking the Court to hold them in criminal contempt of court.

    Also since they did not file and serve their answers they defaulted in appearing and I am asking the court for a default judgment granting me the relief requested in the lawsuit because they failed to oppose it.

    If they oppose this motion and the court relieves them of their default I am asking the court to prohibit Harris Beach from representing Canisius since the own some interest in one of the witnesses to this action. They should not be allowed to represent a material witness and one of the parties.

    I wish I was paying attention to the Town issues earlier. I regret that, but I will be from here on out.

    Whatever, litigation I am in, it is because I believe that the principle of the rule of law has been violated. In this case I believe that the West Seneca Code Enforcement Officer and the Town Zoning Board of Appeals exceeded their authority in this matter.

    Don't forget the Town of West Seneca Legal Department (Greenan and Notaro) who told Code Enforcement what to do. Oh yes, don't forget Paul Clark.

    Nothing happens without Clark's approval.

    These guys are used to jamming things down the citizens' throats. It's good to see people standing up to these folks.
