Although Congressional hearings on President Bush's secret wiretapping program are underway in Washington, the program could receive one of its first legal tests here in Buffalo.
A federal judge has ordered the Justice Department to reveal whether it used the wiretaps against a Lackawanna man.
Mohammed Albanna and two other men were indicted three years ago, charged with illegally sending some $500,000 from Western New York to Yemen.
Albanna's attorney wants to know if Albanna was wiretapped without court approval.
As Channel 2's Scott Brown reports, the results of Albanna's case could help determine whether the President's spying program is legal, or not.
