Any comments on the erosion problems facing home-owners?

The Buffalo News had a story today.

Home-owners responsibility?

Municipality responsibility?

Got a link to the Buff News article? Couldnt find it in search. But did see a WKBW article.

Property taxes are assesed based on properties along the creek right up to the bank. If you loose a major portion of land, it should qualify you for some kind of reduction, yes?

No.

If you own land that abuts any body of water, with the exception of lakes, the Erie Canal and the Niagara and Buffalo rivers, your property goes to the center line of said body. Even if your property description monuments the "high bank" of a creek, you still legally have what are called riparian rights to the center line and are assessed as such. In other words, the square footage of your property would still be the same. The only way anyone could get a reduction is if the erosion hurts the overall value of the property - which is not what most people hope for.
