I am starting a new one to discuss the FACTS about what has been found in the past that has never been corrected by the DEC, Albany, and our Federal agencies.
The purpose of this post is to find a solution that we ALL can live with to ultimately protect our little ones in New York State and correct the legacy we have inherated.
Here are some information about Western New York environmental legacy that needs to be corrected.

For those who saw the post yesterday, it is nice to know there are those who cared enough to download several files. It was necessary for me to create a seperate area to store these files because on some governmental sites, reports are being deleated after it was public. WE PAID FOR THESE REPORTS with our tax dollars. There is no reason to deleate them until the problem is resolved. Many areas in U.S. has been corrected to different degree and we need help in Western New York to resolved and clean up these areas.
Couple of representatives have been helpful but NOT the ones you think would be. It's disturbing when those who you think would help has been extremely silent. Why?
Our children in Western New York and across the state deserve safe schools, safe neighborhoods, and safe environment!
Now, let's start a discussion in a civil manner. I personally would like those who read this check out the facts first in the link above before commenting.

CWM: DEC outlines plan for PCBs
DEC official Jim Strickland says tests are trying to find cause of hazardous materials on facility grounds

PORTER — A state environmental official acknowledged on Monday that PCBs have been detected on the grounds at Porter-based CWM Chemical Services.
An investigation of the grounds outside the landfills — where hazardous materials are deposited — by the state Department of Environmental Conservation showed certain levels of the materials in the sediment. The DEC took about 20 samples of the ground at the facility in an attempt to track down PCBs and determine whether they could affect groundwater, which flows to nearby creeks, said Jim Strickland of the DEC.
“We’re trying to get a better idea of where the areas are in the landfill which could create issues,” Strickland said. “There are places with high levels of PCBs, and we want to remove the PCBs in those places.”
The agency will now order the removal of sediment in two of the spots with the most elevated levels, and further investigate to see if they can find the source of the PCBs, Strickland said. He pointed out that the testing required by the facility’s state SPDES permit — which is currently up for renewal and in the public comment period of that process — has not seen elevated levels of PCBs in three years.
The testing was on a relatively small scale considering the size of the facility, said Amy Witryol, a member of the Citizens Advisory Commission which is attempting to act as a liaison between the community and CWM. Witryol pointed out extremely high levels of PCBs found on nearby land being investigated by the U.S. Army Corps of Engineers and also wording in the current SPDES permit — which she said pointedly states that current detection methods cannot prevent PCBs from being discharged into creeks — as reasons for more extensive testing.
CWM spokesperson Lori Caso reiterated her confidence that no hazardous waste materials leave the landfill.
“Nothing leaves the facility,” she said, adding storm water reports over the last several years have verified it.
n Discussion also centered on whether the CAC is a legitimate group. CWM officials have stopped coming to the meetings, despite repeated invitations, claiming the advisory group expired when CWM’s RMU-1 application process was up. A letter from CWM attorney Daniel Darragh, from the Pittsburgh-based law firm Cohen and Grimsby, came to the same conclusion.
“The terms and conditions in the (CAC agreement) have expired,” the letter said. It did welcome the CAC’s input on another landfill, RMU-2, that CWM hopes to build.
CWM has also held a number of meeting at their facility that are open to the public. Caso said those meetings represent an open line of communication with the community.
“I feel that we are keeping the lines of communication open,” she said. “We’ve been finding that’s a much more effective means because it’s open to a broader group.”
Members of the CAC, who had just received the letter, said despite the technicalities, CWM should be attending their meetings.
“The underlying purpose of the CAC was to create a forum where communities could meet with CWM on a regular basis, as an alternative to being in an adversarial setting,” said Nils Olsen of Youngstown, the CAC’s original chairman who helped craft the agreement. “It’s an opportunity where parties could get together and share what concerned them. It’s unfortunate that underlying concept is no longer being followed in the community.
“It would be nice if that purpose could be resumed at some point.”

The Royalton Hartland data you inquire about is part of our FMC - Middleport
file. The file is quite extensive (ballpark 4 to 6 feet think) and encompasses
sampling and reports from the 1970's to recent. Two interim measures (IM's)
were taken on the school property, 1996 Bleacher area, and 1999 sport field
area. These actions were taken because an EPA risk assessment of the available
data found the arsenic levels to be such that they posed an unacceptable risk.
After the IM action, a new assessment found the concentrations to be within an
acceptable range for use as school property. Attached is a table containing all
the arsenic data on the R-H School property outside of the area of the 1999 IM
(1985-1999ArsDataRHSchoolFinal.wpd). Also attached is an FMC map showing sample
locations and arsenic data, post the 1999 IM. Be advised that the data from the
IM area which appears on a grid is 0.5 feet to several feet below the surface
since this area was backfilled with "clean" soil (2005R-HSchoolAsSoils.pdf).
And, I have attached The EPA/DEC/DOH letter that was sent to the school after
the IM was complete. This letter is still the State and Federal Agencies
position with regard to the R-H School soils (2000R-HSchoolPostICMLetF.pdf). The
tentative schedule for a draft corrective measures study (CMS) regarding the
school property is anticipated to be available for public review in early 2009.
This document will look at all the available data with respect to property as
best use.such as residential.and reevaluate whether additional actions are
warranted. And lastly, there will be a public meeting in Middleport on March
24th to discuss other projects surrounding FMC and other offsite actions.
While the immediate discussion may not touch on the school property, the
appropriate people will all be present to answer any in-depth questions you may
have. I can forward you more specific information about this meeting to you if
you are interested as it becomes available to our Department.

I have not heard or received information regarding the sample test results taken
on
Lewiston Rd., Niagara Falls, NY. Also, I was informed by the former
Commissioner,
Paulette Kline, information was to be sent out to the residents on Lewiston Rd.
regarding
the findings as well as procedures to safeguard the workers and the community
from
radiological issue. A standard operating procedures were to be worked out with
the guidance
by the county and state agencies for the engineers and contractors for the
Lewiston Road
project. It's been over 2 months now since the samples were taken.
I would like your assurance as well as documentation of findings along with the
proper
procedures sent to me as promised by Paulette Kline and Jim Devald.

Mary3, thank you for providing the unedited documents. It's refreshing to see someone trying to provide accurate information without speculation. Nothing good will ever come out of the constant personal attacks some continue to post.
As for the allegations about financial disclosure, you are correct. You do not receive compensation and did not participate in an election process. It is not required. Keep up the good work.

I read the full assessment made regarding the "Love Canal Follow-up Health Study which was done by ATSDR by the center for environmental health New York Stae Department of Health for the U.S. Department of Health and Human Servies dated October 2006.
I would love to hear what Loise Gibbs thinks of the report.
My conclusion based on the report is that they could not conclude anything definitively. Very sad thing to see. I think they were covering their buts.

I am pleased to invite you to a public meeting to discuss progress of the Community LOOW Project concerning the former Lake Ontario Ordnance Works (“LOOW”) site located in the Towns of Lewiston and Porter, NY. The first meeting to introduce the project was held in November 2005. Subsequent meetings were held in September 2006, June 2007, and this will be the fourth meeting.
The purpose of the meeting is to provide an update to members of the community on our progress, with emphasis on the Geographic Information System and how we intend to use it for our gap analysis. A live demonstration of the LOOW GIS mapping website is planned. This website is being used by the project team to better understand the environmental investigations that have occurred and will ultimately be made accessible via internet to the entire community.
Further information concerning the Community LOOW Project and the LOOW in general can be found at the project website. If you have internet access, go to www.niagaracounty.com/health and click on “Health Resources”, then click on “Niagara County Community LOOW Project”. You can also find links to other LOOW websites at our website.
The meeting will also be an opportunity for members of the public to provide us with data or information they may have that will assist our efforts. The meeting was interesting. Here is the skinny. The website that everyone can check is www.communityloowproject.com.
I have asked the project manager, Scott King to add the following:
1. GIS level pertaining to wetland should show the past wetland areas BEFORE it was filled it.
2. The actual link of the documents used should be posted to understand the full context of the testing
3. The readings done must be posted eventhough no soil tests were done.
4. The flow of surface water should also be included in time of heavy rain and thaw (sp?).
5. The directional wind pattern by season and historical temperatures
6. Current studies of health problems by zipcode, census info
(Of course there would be disclaimer that the statistics are not "proof" of cause)
For all those who feel the envirnmental issues regarding the site was full of *@!@, you need to see the above site. Much improvements are needed and the work in progress.
Oh, there was that woman who has been ordained by politicians and local group as "spokes person" and "know it all" who had a "discussion" with my hubby when asking Dan Stapleton a question for the Health Department.

Talked to Jim Devald and the road project for Lewiston Rd. is on hold until the new engineer is hired by Mayor Dyster. I have sent Mayor Dyster information about the area so that the ball doesn't get dropped. The SAIC report is not available yet per Jim Devald.

heres a thought, why dont we as americans DEMAND that the companies that made the mess, clean up the mess?
Why do we as tax payers always get stuck footing the bill for someone elses mess?
If I dump a 5 gallon pale of used motor oil in my front yard, the EPA and other govt agencies will make ME, the private homeowner, foot the bill for cleaning up the 'spill'. Why cant we make these companies do the same?

I agree that the comany/entity responsible needs to clean up the mess they have left. Except, the land that was "certified" as clean by our Federal entities, is not clean. The land was sold to various companies and the current occupant is CWM, a toxic waste landfill company. Our tax dollars are being used by Army Corp of Engineers to continue the testing, and the solution for remediation on CWM property. CWM is a subsidiary of Waste Management, an international company with lots and lots of money. Why are WE paying for the Army Corp's work is the question I have. The due dilligence by CWM should have known the land was still contaminated and the powers that be said why not use the land for toxic waste landfill since the land is already contaminated?
If as private citizen building a home, we have to do our due dilligence and have environmental testing BEFORE we are even allowed to get a loan for building a home. Did CWM do their testing? Who autorized it "clean", was shortcuts made to accomodate a toxic landfill licensing since it was already contaminated? Recent Buffalo News article mentions underground containers to be removed from CWM property by the Army Corp with is being funded by our tax dollars. Is this right? Should Army Corp demand CWM to clean it up? I think so. Why do we continue to give corporate welfare to companies making so much money? I would say it's the environment of the current administration and failure of past ones.
The problem today in Niagara County is the lack of money and funding to clean up all the areas left contaminated by previous occupants for the health and safety of residents living around it.
There is an economic development for upstate where "shovel ready" land after cleanup will be re-occupied by new corporations which is being funding by our tax dollars.
People in Niagara Falls talk about the disfuntional government but, I personally think there was the same disfunction in the entire state and the country. It's time for change and the mindset of residents in our area to say "NO" we are not going to be ignored and demand cleanup especially near schools and residents FIRST.

Through my own personal researching into the toxic waste sites around WNY, I find it QUITE disturbing that our elected officials have turned a blind eye to this extreme health risk.
We in this entire area, buffalo, niagra falls, all of WNY, are exposed to all these heavy metals, and toxic, sometimes nuclear, waste. Why is it, that Yucca mountain is sorround by hundreds of miles of 'nothing' and the waste is being buried DEEP under ground, and yet, the LOOW Site, is right next to the Lewiston/Porter schools?
What really has me stumped, is there was a huge uproar over the Love Canal, yet the LOOW Site, apears to me, as a much more dangerous place. Not only that, but there are sites dotted all over Niagra Falls which contain both toxic and nuclear waste, that has so far, yet to be cleaned up.
And people actually wonder why this area is so depressed, and no businesses want to be here? WTF in thier right mind would want to build a tourist attraction atop a Nuclear/Toxic waste dump site?!
It sickens me that with all this waste, the area is largely ignored by most outside the region. It just goes to show, how the govt really cares about the safety and well being of the people. If we all stopped paying our taxes, and demanded they force those responsible to clean up the mess, we'd all be homeless.

Was it 60 or 70 people attending? I think it was more like 90 people who attended.
The two persons who is in favor of CWM should consider the following:
The truckers would most likely be safer and better off trucking fills for economic improvement than trucking toxic waste to be burried in the ground.
The total number of jobs at CWM facility who are a mix of scientists, environmental engineers, laborers most likely would rather work on safer and alternative meathods other than landfilling so called "treated" waste. The future security of their jobs would be better if they worked on safer methods of producing goods than the current "dirty and toxic" job they have. The environmental engineers who are currently hired by CWM would be also better off if they worked on the multitude of environmental problems in WNY and the job security can be guaranteed by the New York State for WNY area for remediation and brownfield cleanup.
I totally agree with the Buffalo Niagara Realtor's association, having a COMMERCIAL Hazardous Landfill does nothing for the community.
Tax base will increase with additional eco-friendly development in Western New York when CWM closes down.
Any of you who have read the multitude of discussions on the probems that still plague our area from the Manhattan Project knows, there are definately good jobs to be had for years to clean it up.
It was a terrible idea to have a commercial hazardous waste facility so close to Lower Niagara River and Lake Ontario. It's time to say our community needs environmental justice once and for all.
Remember, we have the world's 20% of fresh water flowing down the Niagara River that must be protected.

Bond approval Monday will pave way for street’s reconstruction
Back when the roads were being paved in the late 50's and 60's the environmental concerns about radiation, exposure, and the limits are not what it is today. Then current infastructure projects for roads across the country, our federal government allowed certain "slags" to be used for roadfill and beds. During the decades to come, the "low level" radioactive materials we the responsibility of the each state according to the NRC.
I honestly believe the engineers and the mayor at the time knew about the dangers.
We all pay the price. Just look at all the brownfields left by various defunked companies in our area. Who pays for the cleanup? We do.
What's important is that we learn from our mistakes, take caution to protect the health and safety of our community and go forward.

DOE will investigate this issue further by retrieving records from the remediation and searching for the exposure assumptions used for the dose calculation you provided.
The DOE-LM has coordinated this response with the U.S. Army Corps of Engineers. Questions regarding DOE activities completed prior to 1997 will be answered by the DOE. USACE will respond to questions regarding post-1997 and future FUSRAP activities. The DOE and USACE will jointly address concerns such as yours and determine if additional FUSRAP investigations or actions by USACE are warranted to protect human health and safety.
One of LM’s primary missions is to assure environmental remedies at all LM sites remain protective of human health and the environment. We will complete the additional investigations noted above to determine if that primary mission is being met at this site. We will provide you with our findings no later than June 15, 2009.
The above is a portion of the letter I received for investigation. It is my view DOE "missed" some spots in areas they deamed "clean and certified". I do hope they will own up to their responsibility and clean up what they have missed. Our State already have a heavy burden for too many sites.

The funding for these Western New York public works projects is part of a $4.6 billion investment for the Corps of Engineers to improve infrastructure and safety across America – an investment expected to create 57,400 construction jobs directly and an additional 64,000 indirect jobs to supply and support construction projects

We have been asking for more security for several years, and it's going to happen..FINALLY!
Persistance does pay. Suggestion to the Niagara County, no need for hiring lobby groups, just write your own letters, request the funding for various needs of the county, ask local residents to do the same and you'll save the tax payer money.
If you get individuals involved great things can happen.
